INDONESIA'S INTEREST BEHIND THE RATIFICATION OF MONTREAL CONVENTION : THE LIABILITY OF AIR CARRIAGE

Skripsi ini membahas mengenai kepentingan Indonesia dibalik keputusannya dalam meratifikasi Konvensi Montreal 1999. Konvensi Montreal 1999 adalah salah satu aturan terbaru yang dibentuk oleh ICAO diamana peraturan ini mengatur mengenai tanggung jawab pihak maskapai dalam penerbangan internasional. Pada dasarnya konvensi tersebut merupakan bentuk modernisasi dari Konvensi Warsaw 1929. Konvensi Warsaw 1929 sebelumnya sudah diamandemen beberapa kali melalui Protokol Den-Haag 1955, Konvensi Guadalajara 1961, Protokol Guatemala City 1971, Protocol Montreal 1-4 1975. Namun meskipun sebelumnya sudah beberapa kali diamandemen, Indonesia hanya meratifikasi Konvensi Warsaw 1929 dan Konvensi Montreal 1999. Dalam menganalisis pokok permasalahan, penulis melakukan studi literatur dengan menguji beberapa data yang diambil dari buku, jurnal, dan berita. Hasil dari penelitian ini menunjukan bahwa keputusan ratifikasi Konvensi Montreal 1999 yang dilakukan Indonesia berhubungan dengan pilihan rasional yang mempertimbangkan kondisi industri penerbangan dan juga kepentingan beberapa aktor. Penulis berharap kedepannya penelitian ini akan bermanfaat terutama untuk penelitian-penelitian yang memiliki topik serupa.

This thesis is to show Indonesia's interest behind the ratification of Montreal Convention 1999. Montreal Convention 1999 is one of the latest rules issued by ICAO that regulate the liability of international air carriage. Basically this convention is a form of modernization of Warsaw convention 1929. The Warsaw Convention 1929 actually have already amended several times by Protocol Den Haag 1955, Guadalajara Convention 1961, Guatamela City Protocol 1971, Montreal protocol 1-4 1975. In fact among those conventions and protocols, Indonesia only ratifies Warsaw Convention 1929 and Montreal Convention 1999. To analyze the problem, the writer conducted literature study by examining the related printed or online books, journals, and news. The result of the research show that Indonesia ratified the Montreal Convention 1999 is related to the rational choice that consider the condition of its aviation and some actors interest. Hopefully, this thesis will contribute to future research on similar topics.
