PERAN PEMERINTAH DAERAH KABUPATEN SLEMAN DALAM SISTEM PENGUPAHAN SERTA PERLINDUNGAN HUKUMNYA KEPADA TENAGA HONORER KATEGORI 2 (K2) BIDANG PENDIDIKAN DI KABUPATEN SLEMAN

Implikasi berlakunya otonomi daerah memberikan hak dan batasan kepada kepala daerah, sesuai dengan yang diamanatkan oleh Pasal 4 Ayat (2) UU No. 23 Tahun 2014 tentang Pemerintahan Daerah. Pada peraturan tersebut menyatakan bahwa daerah kabupaten/kota merupakan wilayah administratif yang menjadi wilayah kerja bagi kepala daerah dalam menyelenggarakan urusan pemerintahan umum di wilayah daerah kabupaten/kota. Wewenang pemerintah tersebut salah satunya ialah terkait dengan pengangkatan pegawai negeri sipil dan pengangkatan honorer di daerah sebagaimana diatur dalam PP No. 56 tahun 2012 yang merupakan perubahan ke dua dari PP no. 48 Tahun 2005 tentang Pengangkatan Tenaga Honorer Menjadi Calon Pegawai Negeri Sipil. Namun demikian, dengan berlakunya UU No. 5 tahun 2014 tentang Aparatur Sipil Negara maka istilah tenaga honorer kemudian tidak diatur lebih lanjut, sehingga status tenaga honorer tidak memiliki kejelasan, serta juga belum terdapat regulasi yang mengatur lebih lanjut terkait status tenaga honorer tersebut. Berdasarkan pemaparan diatas, penulisan hukum ini ditujukan untuk mengetahui peran Pemerintah Kabupaten Sleman dalam sistem pengupahan tenaga honorer kategori 2 di Kabupaten Sleman, serta Perlindungan Hukum Terhadap Sistem Pengupahan Terhadap Tenaga Honorer Kategori 2 (K2) Bidang Pendidikan Di Kabupaten Sleman. Penelitian pada penulisan hukum ini menggunakan metode normatif empiris, sehingga menghasilakan data primer dan data sekunder. Data primer adalah data yang diperoleh dari hasil wawancara dengan subjek penelitian di lapangan dengan menggunakan teknik non random sampling, sedangkan data sekunder adalah data yang diperoleh dari hasil studi kepustakaan. Selanjutnya data tersebut di analisis dengan metode kualitatif, yakni memaparkan secara deskriptif yang mana menghubungkan antara data sekunder dan data primer untuk memenuhi tujuan penelitian yang diajukan penulis. Berdasarkan hasil penelitian penulis di Kabupaten Sleman, Daerah Istimewa Yogyakarta terkait judul penelitian tersebut, ditemui bahwa peran dari Pemerintah Daerah Kabupaten Sleman ialah sebagai pendistribusi upah tenaga honorer K2 di tingkat kabupaten kota, mengatur sistem pengupahan tenaga honorer kategori 2 yang mana sumber anggarannya bersumber dari dana APBD, serta melakukan pengawasan atas pelaksanaan dan pendistribusian dana tersebut.

Implication of the enforcement of regional autonomy gives the right and limitation to the regional head, as mandated by Article 4 Paragraph (2) of Law no. 23 of 2014 on Regional Government. The regulation states that the regency / municipality other than the status as a region is also an administrative area that becomes the working area for the regional head in carrying out general government affairs in the regency / city area. The authority of the government is one of them is related to the appointment of civil servants and the appointment of honorary in the region as regulated in PP. 56 of 2012 which is the second change of PP no. 48 Year 2005 on the Appointment of Honorary Personnel Becoming Candidate for Civil Servant. However, with the enactment of Law no. 5 year 2014 on the State Civil Apparatus hence the term honorary workers then not further regulated, so that the status of honorary staff does not have clarity, and also there is no regulation that further regulate the status of honorary workers. Based on the above explanation, the writing of this law is aimed to know the role of Sleman Regency Government in the reward system of honorary laborer category 2 of education department in Sleman Regency, and Legal Protection of Wage System for Honorary Power Category 2 (K2) In Sleman District. Research on the writing of this law using empirical normative method, so that the primary data and secondary data. Primary data is data obtained from the results of interviews with research subjects in the field by using non-random sampling technique, while secondary data is data obtained from the results of literature study. Furthermore, the data in the analysis with qualitative methods, namely describing descriptively which connects between secondary data and primary data to meet the research objectives proposed author. Based on the writer's research in Sleman Regency, Yogyakarta Special Region related to the title of the research, it is found that the role of local government of Sleman Regency is to distribute the salary of honorarium K2 at city district level, to regulate the wage system of honorary laborer of category 2 where the source of fund is from fund APBD, as well as to supervise the implementation and distribution of these funds.
