ASPEK EKONOMIS DAN SOSIOLOGIS DALAM PENETAPAN HONORARIUM NOTARIS DI KABUPATEN BOYOLALI

Penelitian ini bertujuan untuk mengetahui dan menganalisis apa yang menjadi pertimbangan penetapan honorarium Notaris dan bagaimana penetapan honorarium Notaris di Kabupaten Boyolali ditinjau dari aspek ekonomis dan sosiologis. Jenis penelitian yang digunakan penulis dalam penelitian ini adalah yuridis penelitian empiris. Penelitian ini dilaksanakan di Kabupaten Boyolali. Teknik pengambilan sampel dilakukan dengan non probability sampling, dengan memakai purposive sampling. Analisis data dilakukan dengan menggunakan pendekatan kualitatif dan hasilnya disajikan secara deskriptif. Hasil penelitian ini menunjukkan bahwa dasar pertimbangan dan penetapan honorarium Notaris di Kabupaten Boyolali ditinjau dari aspek ekonomois dan sosiologis, dipengaruhi oleh beberapa faktor. Faktor yang ditinjau dari Aspek Ekonomis yaitu melihat nilai ekonomis objek akta, perkembangan perekonomian daerah, kemitraan notaris dengan perbankan, tingkat kesulitan akta, situasi dan tujuan pembuatan akta. Faktor yang ditinjau dari aspek sosiologis yaitu melihat nilai sosiologis suatu akta, lingkungan dalam masyarakat, asas kepercayaan, tujuan dari dibuatnya akta dan kemampuan klien.

This research to understand and analyze the considerations of economic and sociological aspects in establishing honorarium of Notary and determine the honorarium of Notary in the Regency viewed from the aspect of economic and sociological aspects in Boyolali Regency. This research is empirical research. This research was done in Boyolali Regency. Samples were taken by non-probability sampling, using purposive sampling. Data were analyzed using qualitative approach and the results are presented descriptively. The results of research indicate that the basis of consideration and determination of honorarium Notary in Boyolali Regency in terms of economics and sociological aspects, influenced by several factors. Factors reviewed from the Economical aspect that is see the economic value of the deed object, the development of the regional economy, notary partnership with banking, difficulty level deed, situation, and the purpose of making the deed. Factors reviewed from the sosiological aspect that is see the sociological value of a deed, environment in society, the trust principle, the purpose of making the deed and client capability.
