Penelitian ini juga bertujuan untuk mengetahui dan menganalisis dapat tidaknya Hukum Ketenagakerjaan Indonesia diterapkan dalam hal terjadi Pemutusan Hubungan Kerja oleh Perusahaan Asing terhadap Tenaga Kerja Indonesia yang bekerja di Representative Office Perusahaan Asing di Indonesia berdasarkan (Studi Kasus Putusan Nomor: 278 K/Pdt.Sus/2011). Penelitian ini bersifat normatif dan empiris. Data diperoleh melalui penelitian kepustakaan terhadap data sekunder yang terdiri dari: bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, serta wawancara kepada narasumber. Data selanjutnya dianalisis secara kualitatif dan hasil analisis disajikan secara deskriptif. Hasil Penelitian menunjukkan bahwa kedudukan hukum Kantor Perwakilan/Representative Office menurut Peraturan Kepala Badan Koordinasi Penanaman Modal Republik Indonesia Nomor 15 Tahun 2015 Tentang Pedoman Dan Tata Cara Perizinan Dan Nonperizinan Penanaman Modal adalah tergantung dari fungsi dan tujuannya, dimana BKPM (Badan Koordinasi Penanaman Modal) mengeluarkan 3 (tiga) jenis Izin Kantor Perwakilan/Representative Office yang terdiri dari: Izin Kantor Perwakilan Perusahaan Asing (KPPA), Izin Kantor Perwakilan Perusahaan Perdagangan Asing (KP3A), dan Izin Kantor Perwakilan Badan Usaha Jasa Konstruksi Asing (BUJKA), selanjutnya Eriks Pte Ltd Representative Office Indonesia merupakan Representative Office yang berjenis Kantor Perwakilan Perusahaan Perdagangan Asing (KP3A). Selain itu, Hukum Ketenagakerjaan Indonesia dapat diterapkan dalam hal terjadi Pemutusan Hubungan Kerja oleh Perusahaan Asing terhadap Tenaga Kerja Indonesia yang bekerja di Representative Office Perusahaan Asing di Indonesia berdasarkan (Studi Kasus Putusan Nomor: 278 K/Pdt.Sus/2011).
The research entitled "Implementation of Termination of Employment Relationship by Foreign Company to Indonesian Workers Who Work in Representative Office of Foreign Company in Indonesia (Case Study of Court Decision Number: 278 K/Pdt.Sus/2011)" aims to know and analyze the position of Representative Office of Foreign Company in Indonesia based on Regulation of the Head of the Capital Investment Coordinating Board of the Republic of Indonesia Number 15 Year 2015 concerning Guidelines and Procedure of Licensing and Non-Licensing of Capital Investment. This research is also aims to know and analyze whether or not the Indonesian Employment Law is applied in the case of Termination of Employment Relationship by Foreign Company to Indonesian Workers who work in Representative Office of Foreign Company in Indonesia based on (Case Study of Court Decision Number: 278 K/Pdt.Sus/2011). This research is normative and empirical. Data obtained through library research on secondary data consisting of: primary legal materials, secondary legal materials, and tertiary legal materials, as well as interviews to resource persons. The data are then analyzed qualitatively and the results of the analysis are presented descriptively. The results of the study indicate that the legal position of Representative Office according to Regulation of the Head of the Capital Investment Coordinating Board of the Republic of Indonesia Number 15 Year 2015 concerning Guidelines and Procedures for Licensing and Non-Licensing of Investment is dependent on its function and purpose, whereby BKPM (Investment Coordinating Board) issued 3 (three) types of Representative Office License consisting of: License of Representative Office of Foreign Company (KPPA), License of Representative Office of Foreign Trade Company (KP3A), and License of Representative Office of Foreign Construction Service Company (BUJKA), further Eriks Pte Ltd. Representative Office Indonesia is a kind of Representative Office of Foreign Trade Company (KP3A). In addition, Indonesian Employment Law may be applied in the event of Termination of Employment Relationship by Foreign Company to Indonesian Worker who work in Representative Offices of Foreign Company in Indonesia based on (Case Study Decision Number: 278 K / Pdt.Sus / 2011).
