IMPLEMENTASI PENYIDIKAN TERHADAP PENANGANAN PERKARA PIDANA ANAK DI POLRESTA DEPOK

Penelitian ini bertujuan untuk mengamati implementasi penyidikan Terhadap penanganan perkara anak di Polresta Depok, mengkaji proses penyidikan, mempelajari dan mengamati penerapan system peradilan pidana anak di wilayah hukum Polresta Depok, mengetahui faktor-faktor yang menyebabkan munculnya problematika penyidikan tindak pidana anak di Polresta Depok dan memberi masukan, saran, kritik serta umpan balik bagi pelaku penegak hukum khususnya Kepolisian serta masyarakat pada umumnya akan pentingnya pengetahuan hukum dan kesadaran hukum, wilayah hukum kota depok dengan latar belakang tingginya kenakalan dan perkara anak di kota Depok menjadi dasar dipilihnya lokasi penelitian. Metode penelitian yang digunakan dalam penelitian ini adalah dengan pendekatan secara normatif dan empiris. Adapun sumber dan jenis data adalah data primer yang diperoleh dari studi lapangan yang dilakukan pada Kepolisian Resor Kota Depok sedangkan data sekunder diperoleh dari hasil studi pustaka. Data yang diperoleh kemudian diolah dengan cara memeriksa dan mengoreksi data, setelah itu data diolah dan diadakan analisis secara kualitatif. Hasil penelitian menunjukkan proses berlangsungnya penyidikan terhadap perkara anak di Polresta Depok telah merujuk kepada sistem peradilan pidana anak yang berlaku, walaupun penyidik ternyata masih dalam tahap penyesuaian dalam menerapkan UU Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, penyidik telah menerapkan upaya diversi pada setiap perkara yang unsur-unsur nya sesuai dalam kriteria dan syarat-syarat diversi, namun beberapa hambatan yang perlu diselesaikan adalah masalah sulit nya anggaran penyidikan, fasilitas yang belum maksimal, tidak adanya ruang tahanan khusus anak di Polresta Depok, serta kurang maksimalnya pembekalan pengetahuan penyidik tentang sistem peradilan pidana anak menjadi problematika yang harus di evaluasi guna berjalannya proses penyidikan dengan baik, untuk itu ke depannya Polresta Depok agar memberikan perhatian terhadap problematika yang dapat menghambat proses penyidikan, secara keseluruhan para Penyidik yang menangani perkara anak di Polresta Depok sudah maksimal dalam menjalankan tugas dengan serangkaian hambatan yang ada. This study aims to observe the implementation of the investigation of the handling of children's case in Police Resort Depok City, reviewing the investigation process, studying and observing the application of the criminal justice system in Depok Police, knowing the factors causing the problematic problem of the investigation of child crime in Police Resort Depok City and giving Input, suggestion, criticism and feedback for law enforcer especially Police and society in general about the importance of law knowledge and legal awareness, jurisdiction of depok city with background of high mischief and child case in Depok city become base of chosen research location. The research method used in this research is by normative and empirical approach. The source and type of data is primary data obtained from field studies conducted at Police Resort Depok City while secondary data obtained from the literature study. The data obtained then processed by examining and correcting the data, after which the data processed and held a qualitative analysis. The results of the research indicate that the process of investigation of the children's case in Police Resort Depok City has been referring to the applicable criminal justice system, although the investigator is still in the adjustment stage in applying Law Number 11 Year 2012 on the Criminal Justice System of the Child, the investigator has applied the diversion in each case Whose elements are appropriate in the criteria and requirements of diversion, but some of the obstacles that need to be solved are the difficulty of the budget of investigation, the lack of facilities, the lack of special detention room of the Depok Police, and the lack of maximum knowledge of the investigator about the system The criminal justice of the child becomes a problem that must be evaluated in order to proceed the investigation process well, for that in the future Police Resort Depok City to give attention to problematics that can hinder the process of investigation, as a whole the investigators who handle the case of children in Police Resort Depok City has the maximum in carrying out the task with a series of obstacles that exist.
