Kebijakan Pekerja Asing Temporal di Jepang dalam Perspektif Norma Perlindungan Pekerja Asing

ABSTRACT The Technical Intern Training Program is a Japanese Government’s policy that permitting Japanese enterprise to hire temporary foreign workers. The difficulity that faced enterprise to recruit local workers is one of the drive factor behind this policy. Through this policy, recruiter can employ migrant workers up to three years contract duration. However, government is not defining migrants in this category as a worker. This case shows that the policy is incompatible with the stipulations of foreign migrants’ protection norm that stated rights equality amongst migrants and citizens. Government’s priority on the matter appear to be low, as conventions related to the norm is not yet ratified. Differences between domestic values on immigration matter and norm’s stipulation is the factor that inhibiting ratification. Conservatism on immigration policy concept and implementation is one of the form of domestic values aforementionend.
