Sustainabilitas Independensi Kewenangan Ombudsman Daerah DIY: Penanganan Kasus Maladministrasi Proyek Code Division Multiple Access(CDMA)

ABSTRACT This study discusses about sustainability of the Yogyakarta Local Ombudsman‟s independence in carrying out their authorities in handling of maladministration that involves the regional executives described through the cases handling of maladministration CDMA projects. The results of the CDMA cases handling showed there are some maladministration acts by the Governor of Yogyakarta, Regional Secretary of Yogyakarta, and Head of BPKD DIY. It is causing a various responses, including the head of regional executive, and affect to the independence of the implementation of the Yogyakarta Local Ombudsman authorities on the next periods. This study aims to describe the independence of Yogyakarta Local Ombudsman as external oversight institution in dealing with CDMA maladministration cases which involves regional executives and sustainability of the Yogyakarta Local Ombudsman‟s independence in carrying out their authorities post-handling of CDMA project cases. This study used qualitative method with study case approach. The data was collected through interviews and document/data archives. Furthermore, the data were analyzed and interpreted according to its stages. The results of this study indicate that the implementation of The Yogyakarta Local Ombudsman‟sauthority in order to handle the CDMA project caseshas acted independent. It was shown by theiracts to produce conclusions/recommendations and publish to media local although the executives become the suspects. Then, for the sustainability of the Yogyakarta Local Ombudsman‟s independence in carrying out their authorities post of CDMA cases handling, has not done independent. It was indicated by the change of the authority set out in Pergub No. 21 Tahun 2008 and Pergub No. 69 Tahun 2014, including the terms of publication, recruitment, and the preparation of quarterly and annual reports submitted to the Governor through the Law Bureau.
