Compulsory Conciliation sebagai Langkah Manajemen Konflik Sengketa Celah Timor

2016 | Skripsi | Ilmu Hubungan InternasionalABSTRACT Timor Gap dispute has been a prolonged conflict pre-independence of Timor Leste. The root cause is different interpretation in maritime boundaries where Timor Leste uses median line as a standard, while Australia resists using continental shelf. In fact, UNCLOS has conceded median line as the most right standard, therefore Timor Leste must have obtained her right upon the sovereignty there. Australia keeps denying the fact and eventually the countries always produce agreements which concern to sharing profit in Timor Gap. Nevertheless, Timor Leste is always in the aggrieved side, particularly after the espionage of Certain Maritime Arrangement of Timor Sea (CMATS) which affects to Timor Leste’s preference to compulsory conciliation under the provision of Permanent Court of Arbitration (PCA). The considerations are Timor Leste is powerless than Australia is, and by this approach, it can be beneficial for equalizing bargaining position, enhancing international reputation, and can reach her national interest. Not merely analyzing from the ethical conduct of diplomacy, but also seeing from a state as an rational entity in international relation.
