2016 | Skripsi | Ilmu Hubungan InternasionalAbtrack In 1988, it is known that the fungicide and pesticide function of Neem Tree extract has been patented by biotechnological firm from United States. These privatizations of biological resource trigger the public outrage in India. That is because the fungicide and pesticide extract of Neem Tree has been used by Indian people for centuries. The patent of Neem Tree extract would be really harmful for Indian agriculture. This activities known as biopiracy, a terminology that refers to the appropriation of the knowledge and genetic resources of farming and indigenous communities by individuals or institutions that seek exclusive monopoly control over these resources and knowledge. It is article 27.3 (b) under the Trade-Related Aspect of Intelectual Property Rights (TRIPS) Agreement that being the justification of that action. This research would describe the political contention happened because of the ambiguity of those article by focusing on Neem Tree case in India.
