ABSTRACT This undergraduated thesis discusses dispute settlement process between Indonesia-USA with clove cigarette commodity. Indonesia as the largest producers of clove cigarette in the world accused that US policy regarding tobacco control act discriminate clove cigarette and menthol cigarette in US domestic market. Indonesia decided winning the case by WTO, on DSB Panel and Appellate Body, and USA needs to adjust their tobacco control act to meet the requirements of WTO laws and rules. Indonesia & USA finally decided to stop the dispute by cooperation in trade. Keywords: WTO, Rational Choice, National Treatment, Indonesia, United States of America
