Strategi Proteksionisme Jepang Dalam Sengketa Perdagangan Komoditas Nori Dengan Korea Selatan Tahun 2004-2006

With the coming of globalization in the international politics realm, individualistic national-interest of the nations are being molded into the international norm practices, such as the international trade norm of World Trade Organization (WTO). Japan, as one of the contracting party of WTO, has to obey over the WTO‟s spirit of liberalization, eventhough contradicting onto its national-interest to protect its domestic agricultural comodities. In the 2004, South Korea subjected Japan into the dispute settlement panel of WTO, argued that Japan had discriminated South Korea‟s laver comodities with the hyper-protective import quota system by series of law and policies. But, at the same time, Japan could reverse its pressuring situation with its „disguised protectionism‟ strategy assuring Japan‟s actions were appropriate to the WTO‟s law. This case is showing us on how Japan could act cunningly to protect its domestic laver comodities without conflicting with the liberalizing rules of WTO by using WTO‟s law as the legal justification.
