ABSTRACT Frequencies used by television broadcasts are public domain and included in limited natural resource. The state ruled over the radio frequency spectrum used for broadcasting providence to the people’s prosperity as much as possible. Therefore, there should be broadcasting license in order to avoid the misuse of the frequency. Licensed television broadcasting is appropriate to obey the rules that bind the users of these frequencies. Empirically, the use of public frequency which ideally should meet people’s right to balanced and fair information is actually monopolized. Monopoly over the media ownership and the use of public frequency is so much going on the Indonesian broadcasters. The violations of public frequency usage became more and more widespread, especially in the 2014 General Election of President and Vice President in Indonesia. Normatively, when referring to Broadcasting Code of Conduct and Standard of Broadcasting Program and Broadcasting Regulations, this kind of broadcasting practices is unfair. Indonesian Broadcasting Commission (KPI) should have been adequately powerful by having those mentioned regulations to crack down all forms of violation of public frequency usage. However, with the presence of the Memorandum of Understanding Between KPI and Bawaslu in organizing the 2014 presidential election campaign ads, as there are limitations to the KPI to impose sanctions to the offenders. Whereas, KPI is the ultimate regulator to crack down those who disobey the broadcasting rules. Then, with the existence of this memorandum, how’s the actual position of KPI to monitor the content of television broadcasts related to the use of public frequency in the 2014 presidential election?
