Pengaruh Transitional Justice pada Keputusan Bernegosiasi Pemerintah Kolombia dengan revolutionary Armed Forces of Colombia(FARC)

ABSTRACT The Influence of Transitional Justice to Colombian Government’s Decision to Negotiate with FARC Colombia is deranged by an internal armed conflict that is rooted for decades. Guerilla and paramilitary are the main actors in the conflict. FARC is the biggest guerilla in Colombia, having things done with FARC is believed as the chain drive in the civil war. Unfortunately, overcoming FARC is not easy, Colombian government had used soft and repressive way, but there were no result. From 2002 to 2010 government had stopped the soft way and focused in repressive way. Surprisingly, in 2012, Colombian government decided to hold a talk with FARC. President Santos said the talk would produce good results because government was running TJ. The thesis will analyze the influence of TJ to Colombian government’s decision to negotiate with FARC. The research question is how TJ affects Colombian government to negotiate with FARC? The thesis uses the concept of TJ and negotiation, conflict resolution for civil war, and getting to the table. It elaborates the processes of TJ influencing Colombian government’s decision. There are two processes that explain how TJ influences government’s decision. First, TJ as a discourse has a flexible characteristic so that government can use it to implement such interests. There are two uses of TJ as a discourse, manipulative way and democratic way. Government uses manipulative way to legalize impunity to FARC’s combatants. Implementing conflict resolution is the democratic way. Second, TJ produced a momentum of the turning point in the government-FARC’s relation. The processes are explaining how TJ is affecting Colombian government to negotiate with FARC.
