2013 | Skripsi | Ilmu Hubungan InternasionalABSTRACT China-United States tyre dispute was the first case concerning China-specific Safeguard, particularly China’s Accession Protocol and Section 421 Trade Act 1974. China-specific Safeguard was implemented by United States to block the entry of China’s product only. China’s countermeasures by complaining to Dispute Settlement Body WTO resulted on the win of United States. This paper questions China’s decision to countermeasures US tyre tariff policy in WTO and the nature of special safeguard as a mean of protectionism measures. This paper examines the characteristic of China-specific Safeguard which is easier to implement more than the traditional safeguard measures. It also examines the effect of US tyre tariff policy to China’s domestic tyre industry and export. Tariff imposed by United States is considered as a threat for the development of China’s domestic tyre industry, both in the process of imposing safeguard and the policy’s effect.The US victory in tyre tariff dispute shows that China-specific Safeguard can be used to exceed the rationality of WTO’s traditional safeguard measures. It also shows that WTO hasn’t been able to overcome the protectionist measures implemented by its member.
