ABSTRACT This paper discusses the issue of policy formulation placement and protection of Indonesian migrant workers (TKI) in the atmosphere of democracy in Indonesia under Megawati regime. Placement and protection policies have been starting from background of the failure of many parties (both government like any private company of migrant workers) in dealing with migrant workers, since the recruitment, placement until discharge. The policy of the placement and protection of migrant workers is not aiming for problem solving, but it raises many new cases affecting workers. The main argument put forward is: weakness implementation of Law No. 39 of 2004 on the Placement and Protection of Migrant Workers Abroad stems from unequal formulation process. It is therefore important to keep track of the dynamics formulations that occurred about nine years ago, following the actors, values, and interests, frame rules and process of negotiation and compromise. For this purpose, this research was conducted through a qualitative approach literature. The main documents used for data collection and processing are PPTKILN Minutes of committee bill and the mass media. Inequality formulation proved by the pressure from the government, exclusivity aspirations and policy formulation in the walls of parliament, and political parties influence the decision-making mechanisms. It should be understood that the purpose of forming the government of this Act as a means of presidential election campaign, being at that time the majority of the legislators from the party of the coalition government and its subordinate government (Army / Police faction) that streamlines and accelerates formulation legitimacy. Another finding of this study is the policy-making, since the process of agenda setting, formulation legitimacy bias to elite interests, community involvement is only done to satisfy the symbolic procedure, without changing the decisions that have been defined by power-holders. By tracing back the process of the formulation is not neutral, it is not surprising that to date the placement and protection of migrant workers affairs still reap many problems. The suggestions is to see the dynamics of the placement policy formulation and revision of existing protection of migrant workers, reviewing products Political Parties Act and the Elections of the President, as well as the activation of the role of the public through the mass media.
