Analisis Penyebab Kegagalan FIDA Kenya Menentang Diskriminasi Gender dalam National Land Policy

This study aimed to determine why there is gender discrimination in land law policy. In fact, the original purpose of the legislation is to eliminate discriminastion and provide justive to all the people of Kenya. Patriarchal system that is unavoidable in any sytem in both the social, politics and the constitution will not help the women of Kenya. In this case, FIDA kenya as an NGO played a role in the fight against gender discrimination especially in land law, but the position is not powerfull enough to fight the patriarchal system. In the end I want to underline that FIDA can not provide a solution that can align with the position of women in the patriarchal system in Kenya land ternure through the National Land Policy. It is a marker that the patriarchal system in Kenya is still the same, the National Land Policy wouldn’t change women’s positions and still the same as the previous legislation.
