Along with the increasing conflicts in the international world, the issue of asylum seekers is currently a part of the non - traditional security issue faced by many countries in the world, especially the destination countries. Response and decision from destination countries will be a destiny for a group of people who are desperately in need of protection in terms of recognizing and accomodating their status as a refugee and their basic rights. This paper describes aspects of how human rights issues involved in the political debate in Australia to determine the response and policies of the government for giving protection towards asylum seekers coming from the conflict regions, especially Irregular Maritime Arrivals (IMA). There are several specific basic rights that should be fulfilled despite the undefined status of the asylum seekers. The intersection of human rights interests with national securtiy makes it difficult for the constitency in promoting the protection for asylum seekers’s rights.
