Philippine is the sending country of migrant workers for many countries around the world. The great number of migrant workers makes philippines as the second largest sending country of migrant workers, after Mexico. Philippines labor export policy was started in 1974 when Marcos Goverment decided to fix the destroyed domestic economy. The policy had been the strategy for the goverment to reduce the increasing number of unemployment, which resulted from the bad economic condition. It also could be the source of foreign currency to secure the balance of payment. The goverment has changed, but the condition of domestic economy has no much change. Poverty and unemployment in Phillipine are still the country’s problems. To protect the migrant workers, Philippine has regulation formed as The Migrant Workers and Overseas Filipinos Act of 1995, the revision of Labor Code 1974. The government also set up the Philippine Overseas Employment Administration (POEA) to implement the policy. These policy decisions indicate the increasing intention of the government to manage the overseas workers. However, I consider that the government has the dilemma when implementing these policy. The condisions of domestic economy push the government to send the workers abroad. Deploying workers abroad means eliminating the abundance of workers in the country and becoming the source of foreign currency. The protections from the country of origin usually have weak bargaining position in the receiving country, so it means to let the workers be exploited. But when reducing or even stopping the sending of workers abroad, the country will face the economic problems. This paper will examine how the philippines government face the dilemma through the implementation of the migrant workers policy. This study may inform another country such as Indonesia or India to face the same problems of the migrant workers, even these countries can be better.
