Dinamika Konflik Kepemilikan Tanah:(Studi kasus Konflik Kepemilikan Tanah Pembangunan Gedung DPRD Kabupaten Nagekeo)

2016 | Tesis | S2 Magister Administrasi PublikABSTRACT Land ownership conflict on construction of the Parliament building became one of the many land conflicts that occurred in the Nagekeo regency. Conflicts involving Flori Remi, Efraim Fao, Local Government and Parliament as the main actors have been rolling since 2008 and there has been no settlement is completed until today. The selected approach to conflict resolution is litigation (court) and negotiation. This study used qualitative research with case study approach. Data were collected through the interview process with the actors involved in the conflict, observations at the site of the conflict and collecting data from the documents related to the conflict and these conflict resolution efforts. Based on this study, it was found that the resolution of the conflict with the dominant approach of litigation from 2008 to 2014. The conclusion of this study is conflict resolution by way of litigation makes the process of conflict resolution is never complete because it does not resolve the main issue. Legally there are losers and win, but the reality on the ground carrying the message the potential for conflict remains. Conflict resolution negotiation approach based on local wisdom be the last option which is expected to be a turning point in a comprehensive resolution of this case.
