Peran Unhcr dan IOM dalam Menangani Imigran Ilegal di Rumah Detensi Imigrasi(RUDENIM) Indonesia:(Studi kasus Rudenim Surabaya dan Rudenim Denpasar)

ABSTRACT “Illegal immigrants” have increasingly become an issue in Indonesia since a few years. Their presence in Indonesia was accepted by the Government of Indonesia on the basis of human rights. But in dealing of illegal immigrants, two organizations like UNHCR and IOM engaged by the Government. Both are humanitarian organizations that help illegal immigrants with different tasks and functions. UNHCR focuses on providing international protection in the form of refugee status. IOM focuses on providing basic services and finances facilities related to the needs of immigrants. This thesis sees the role of both organizations in Rudenim Denpasar and Rudenim Surabaya. While implementing the mandates, both of organization found the dilemma so they could not work optimally. There are bureaucratic processes of immigrants; the pattern of the working relations between both of organizations with the rudenims; conditions of illegal immigrants in both of rudenims; internal resource capacity; patterns and internal relations of both organization and the last is motivation of their personnel. That dilemma makes both of organizations can not implemented the traditional humanitarian principle such as humanity, impartiality, independence and neutrality. At the end, these organizations cannot fully give priority to the traditional humanitarian principles. Based on that constrain above, the humanitarian actions by those organizations are directed more to the new humanitarian principle, which is in practicing it they will consider new aspects such as professionalism.
