Abstract This study describes the power of capital which under the state control in the reformation era has caused the unability of the state itself to guarantee the rights of the public welfare. The agrarian resources which basically being under the authorization of the state (state-owned) were on the contrary being managed by the private sector (private own) and so that often bring implications toward the guaranty of the public welfare. This article tries to answer a research question on How does the work of capital under the state control brings impact on ensuring the rights of public welfare in Adipala District, Cilacap? To answer the problem, this research will use the concept framework of agrarian studies, capital power in the agrarian scope, and the welfare rights which is guaranteed in the Covenant on Economic, Social, and Cultural rights. This study uses a qualitative approach with case study method. The research location is in the Welahan Wetan village and Glempang Pasir village, district of Adipala. The expansion of capital has reached the southern coast of Cilacap since the colonial period by making the Cilacap port a commercial traffic of cultivation commodities and military defense. This domination continued in the New Order era in form of exploitation of iron sand conducted by state corporation. The character of state capitalist hand in hand with new order’s militarism did not fade even though reformation has ran on for seventeen years. The domination of capital under the state protection increasingly led to imbalances that afflict the society. This research concludes that the process of capital accumulation in the production of iron sand has eliminated the right for job, the right for adequate housing, the right for land and the right for water and public health. The work of capital has even widen the inequality over the control of agrarian resources in several ways. First, the process of land commodification make people lost their home, yard, farm field, and clean water. Second, the separation of peasant from their land which eliminate these peasant’s job. Third, the politics of space regulation which make Cilacap coast become an area of military defense and metal mining has supported the continuity of capital accumulation. The spatial planning for defensive purpose in Cilacap is inseparable with the history of colonial era and new order era which make Cilacap a basis of military defense and capitalist economy at the same time. The conviction of the state and companies saying that investment in the mining sector will bring prosperity through multiplier effect and the presence of CSR, was in fact only lasted for short time. Society, especially peasant, become the ones who are displaced and losing the right to welfare. This study becomes a portrait showing that the power of capital and military grewsince the new order era led to the failure of the state in ensuring the welfare rights.
