ABSTRACT The purpose of the research is to identify public participation and the determinant of public participation in establishment of Local regulations in Lahat Regency. In 2014, Lahat Regency government has 16 Local regulations. Among those regulations, the only regulation that became troubled was the Local regulation of Lahat Regency No.11 of 2014 on second amendment of Local regulation of Lahat Regency No.4 of 2011 on Local Retribution. Public’s rejection to this regulation indicated public has not been involved in establishment of the regulation. Those, this research is identify public participation in the establishment of Local regulation of Lahat Regency No 11, 2014. The method used is qualitative research that conducted by interview and documentation study and also by triangulation to obtain valid and appropriate data. Next the data is sorted, presented and analyzed, so that the the researchers could draw conclusions from the data that has been analyzed . Public participation in establishment of Local regulations should be exist in the stages of planning, preparation and discussion of Local regulations, but the research result revealed that the participation in the establishment of Local regulation of Lahat Regency No.11, 2014, only found in the preparation stage, while in the stages of planning and discussion there is no public participation. This shows that public participation was not optimal, even more it indicates a participation simbolic/pseudo. Public only be informed and heard but decision is set by the government. Public participation is influenced by the capacity and interest of the public and also the participation mechanisms and government political willingness. Public has the capacity and interest in voicing their aspirations, but the mechanism of participation is very limited and the lack of political willingness of the government. In order to optimize public participation, the government should develop the design of participation mechanism that provide access and public space for public to express their aspirations and guarantee that public’s voices is going to be consideration in the in the establishment of Local regulation. The government must also understand that public participation is very in the establishment of Local regulation, so it may rise a strong political will from the government. Further more public can undertake advocacy and adjudication. Key words : Public Participation, Local Regulation, Lahat Regency.
