HUMAN RIGHTS VIOLATION IN ASEAN Case Study: Rohingya Ethnic ABSTRACT Human rights issue still remains as sensitive discourse In Southeast Asia. This is evidenced by the existence of a number of human rights violations in ASEAN countries. This condition indicates an irony in which ASEAN countries have initiated several agreements to “promote, respect and protection of human rights and fundamental freedoms” as showed in the ASEAN Charter. Establishment of the ASEAN human rights Commission (AICHR) and Asean Human Rights declaration as form of progress in ASEAN human rights norms. Unfortunately, one of the human rights violations are unresolved yet to this day is the Rohingya issue. Rohingya problems are not only restricted to communal conflict, but also religion issue, political (persecution), poverty, and widespread regionally. This thesis is designed to answer the reseach question: how ASEAN response individually (as a country) and collectively (as an institution) regarding on human rights violations of Rohingya ethnic?" firstly, this thesis will review the background of Rohingya by looking at the root of the problems in terms of history, etimology and geography. Furthermore, it will describe the impact in religious life, social, political and economic. Secondly, this reseach question will be analyzed through the concept of human rights universally and regionally in ASEAN using “spiral model”. The results can be concluded that each of ASEAN countries have different response. These were mainly due to the difference of geographic impact and the domestic interests as barrier the achievement of consensus for searching solutions. While the ASEAN response is still limited because of its capability that hampered by the principle of non-interference and state sovereignty which have constructed as a “shared value”. As a result, the human rights violations of Rohingya have addressed merely as a humanitarian issue and the settlement of Rohingya is accordance with the approach from individual country, bilateral agreement or dialogue at regional level.
