ABSTRACT This study discusses about the institutional arrangement of non-structural institution on public service, namely the Institute of Regional Ombudsman (Lembaga Ombudsman daerah) and the Ombudsman Private Sector (Lembaga ombudsman Swasta) DIY. The aims to study is (1) to determine how the dynamics of the process of merging Lembaga Ombudsman Daerah DIY and Lembaga Ombudsman Swasta DIY (2) to get detailed information about the various activities in the implementation process of merging institutions LOD DIY and LOS DIY (3) to know the factors that affect the institutional merging LOD and LOS DIY DIY. Referring to the Question research , the results showed that the dynamics of institutions that occurred on process of merging LOD DIY and LOS DIY is a response to demands for changes associated with Pergub DIY No. 21 of 2008 and Pergub DIY No. 22 of 2008 which was considered incompatible with the conditions and the development and dynamics that happened in the public. However, towards of process an agreement on the new regulation of other emerging issues in affecting the existence of the LOD and LOS DIY DIY. the Issues are three options for the institutional of LOD DIY and LOS DIY, that is to Remove LOD and LOS, to merger LOD and LOS, and LOD and LOS stand each other. This issue raises the pro and contra of the various parties. And on process of Merger LOD and LOS DIY DIY is influenced by several factors: budget, organizational structure, policy interventions and political elements. Thus reflecting the assumptions of experts on the institutional of LOD DIY development process of merging LOD DIY and LOS DIY can be seen from two different viewpoints and contradictory. In terms of structural and institutional of LOD DIY development of the concept of pure explained that the incorporation of institutional of LOD DIY LOD DIY and LOS DIY is a government strategy to achieve the effective and efficient performance and application services more flexible, adaptive and more developed. However, Law Bureau (Biro Hukum) in implementing the strategy is not accompanied with a shared situation so that the ombudsman considers that the decision to incorporate this institutional of LOD DIY is a political policy and overwhelmed by desires interests of some groups. From the research conducted, this research offers some solutions associated with non structural institutional arrangement of that is (1) there needs to be clear road map and grand desain associated with institutional arrangement of of Non Strukutral (2) basis or legal instruments concerning the establishment and structuring of non-structural institution must be strengthened (3) Transparancy of budget mechanisms in the body LO DIY (4) good relations agency that will be combined so that no misunderstanding at the time of the arrangement Keywords: Institutiona dynamics , non‐structural institution, LOD DIY and LOS DIY
