2014 | Tesis | Politik dan PemerintahanABSTRACT This research aims to analytically describes the struggle of the local peasants in the Sub District of Tenggarong Seberang, Kutai Kertanegara District in the Province of East Kalimantan to claim their rights for access to land. Conflict over land eventually leads each of the involved actors to carry certain actions in order to secure their interest as the case highlighted in this research shows. The state’s decision to ascertain the customary land of the local peasants in this sub-district as a conservatory forest has denied them access to the main source of their livelihood. On the other hand, this policy has given broader opportunity for the investors to conduct coal mining activities which further exclude the local indigenous peasants. One of the mining corporations is the MSJ Ltd. whose mining activity has contributed to spark conflict against the local indigenous peasants. The perceived absence of the state among the peasants in this dispute has led them to find alternative solution through the ethnic based mass organization namely Komando Pertahahan Adat Dayak Kalimantan (KPADK) to advocate their cause. This research specifically aims to identify the factors which nurture the resistance movement from among the peasants through this particular organization and its forms of resistance. This research is a qualitative research, designed as a case study. Its findings are, first, there has been common discontent from among the local peasants and the KPADK due to the deprivation of their expectations on issue of protection and recognition of their customary way of life. Second, there has been growing awareness of common ethnic identity. Third, there has been no satisfactory response on the behalf of the MSJ Ltd., especially on the issue of land compensation. Fourth, The state and the business entities (represented by the MSJ Ltd.) have marginalized the local indigenous peasant which KPADK identifies as their fellow ethnic group. The resistance takes direct and indirect forms, through litigation, mobilization of public opinion, and physical resistance with both violent and non-violent means.
