2015 | Tesis | S2 Magister Administrasi PublikABSTRACT In line with the enactment of Law No. 32 Year 2004 on Regional Government that the region has the authority in the mining business. Reinforced in the Law No. 4 of 2009 on Mineral and Coal that both the provincial and local government Regency / town are entitled to management, granting permission, guidance and supervision of mineral and coal mining. So this research aims to find out why the mining company did not adhere to the rules of the Coal mine reclamation in Berauprovince of East Kalimantan. This research use a qualitative descriptive the approach used to give an idea of the condition society in the Berau Regency with pros and cons with the izim mining, environmental hazards, coal of mining permit the process and a portrait of the coal mining implementation of the policy in Berau East Kalimantan Province. The results showed that, (1) .In the implementation the process permits mining sites, there are society that agree and some are rejected the presence of of mining. (2). Conflict between the society, mining company and the government, prolonged until the establishment / granting mining license located in the region Bedungun Sub subdistrict of Tanjung Redeb. (3). Berau regency since the enactment of Prawns No. 4 of 2009, of the request permits or licenses for mineral and coal are no longer be issued. However, is still imposed a of mining permit the process in previous years and the government has yet to implement the mining license by way of auction, but the process does is permits the old mine. (4). Mining companies did not undertake to reclaim mined while in laws and regulations explicitly that the company is entitled given administrative sanctions in violation of the Law, but so far did not been implemented. (5). Local government did not assertive in taking care of mining so that of mining companies indulge without reclamation. Mining companies did not committed to the AMDAL be made then the government, and Parliament is not committed to the maintenance of environmental damage so that the impact of the environmental damage is felt by society Berau. Therefore it the recommendations made, (1). The need for a commitment from mining company to conduct reclamation of the environmental damage caused by mining. (2). The need for a commitment from the mining company in providing assistance or activities of community empowerment through the program of Corporate Social Responsibility (CSR), so that not only the program but make people become very powerful the presence of the CSR program. (3). The importance of commitment and political will of the government to crack down on mining company that did not comply with the Regulatory and make a policy for mining areas far from human settlements, and of mining policies environmentally friendly and sustainable. (4). The need for a commitment from society to better utilize the help of mining company that mines the company at more positive value for society.
