Analisis Konflik Penolakan Pembangunan Geraja HKBP Filadelfia Bekasi Tahun 2013

ABSTRACT Conflict of resistance the construction Filadelfia Batak Christian Protestant Church (HKBP) is located at Jejalen Jaya village RT 01, RW 09 dusun III, North Tambun district, Bekasi Regency. It is one of the issues religious freedom violations that were examined in this study. This case lasted from 2000 until this year and still has not found the point of resolution. It was called a period of cooling down. This conflict began when supporters of the Filadelfia HKBP met resistance from the Jejalen Jaya village (communities who resisted the construction of HKBP Filadelfia) and then it moved from a horizontal conflict to became a vertical conflict against the local goverment Bekasi, which decided to let the court resolve the issue. As we know, the government is a representative state and has the role of problem solver, otherwise the same conflict would arise again like what happened in Jejalen Jaya village who resisted the construction of Filadelfia HKBP. Based on the results, the final decision of the State Administrative Court (PTUN) of Bandung explained that Filadelfia HKBP should receive building permit (IMB) from the local goverment of Bekasi, but until now the goverment has not issued it. Differences in ideology (religion) is one of the root causes of this conflict. In addition, the political interests of the local goverment Bekasi is to maintain its power (power struggle) and so they have not given a building permit to HKBP Filadelfia because of the pressure from the masses and ignore the law. As we know, at the village head level (lurah), the goverment has given the approval of the recommendations by public establishment. However, because of mass pressure, the goverment withdrew its recommendation. Similarly, the government began at the sub district level (kecamatan), religious harmony forum (FKUB) until the district head of local goverment Bekasi (Bupati) resistance to the construction because of the public order and the resistance of communities Jejalen Jaya village. This condition became phenomenan because Indonesia is a country that is based on its laws and Indonesia’s commitment to ratify the ICCPR in 2005. Key words.
