UPAYA MENGURANGI TINGKAT KECELAKAAN KAPAL DENGAN PENERAPAN PASAL 9 PERATURAN MENTERI PERHUBUNGAN REPUBLIK INDONESIA NOMOR 45 TH 2012 TENTANG MANAJEMEN KESELAMATAN KAPAL

Setelah dikeluarkannya Peraturan Menteri Perhubungan Republik Indonesia Nomor 45 Tahun 2012 Tentang Manajemen Keselamatan Kapal, maka jumlah kecelakaan kapal yang terjadi di Indonesia mengalami penurunan. Penelitian ini bertujuan: (1) untuk mengetahui Pasal 9 Permenhub Nomor 45 Tahun 2012 sebagai upaya untuk mengurangi tingkat kecelakaan kapal; (2) untuk mengetahui kendala yang terjadi dalam penerapan Pasal 9 Permenhub Nomor 45 Tahun 2012 di lingkungan pelayaran. Metode pengolahan data yang digunakan adalah pengolahan data secara kualitatif. Data primer diperoleh melalui wawancara,sedangkan data sekunder diperoleh dengan studi kepustakaan. Teknik yang digunakan untuk mengumpulkan data adalah menggunakan multi sumber bukti, yakni: wawancara mendalam (indepth interview) dan observasi data-data sekunder. Hasil peneitian adalah sebagai berikut: (1) Tingginya tingkat kecelakaan kapal di Indonesia salah satu faktor yang mempengaruhi adalah human error (kesalahan manusia). Oleh sebab itu Menteri Perhubungan mengeluarkan Peraturan Menteri Perhubungan Nomor 45 Tahun 2012 tentang Manajemen Keselamatan Kapal (Permenhub 45/2012). Penerapan Pasal 9 Peraturan Menteri Perhubungan Nomor 45 Tahun 2012 tentang Manajemen Keselamatan Kapal dilakukan dengan pemberian sertifikat, baik DOC maupun SMC dan dengan adanya peningkatan pemberian sertifikat dapat menurunkan jumlah kecelakaan kapal. (2) Kendala dalam implementasi Permenhub 45/2012 antara lain: a) kurangnya pemahaman dari beberapa pihak dalam mengimplementasikan Permenhub Nomor 45 Tahun 2012 di pelabuhan dan di kapal, b) banyak pemilik kapal tidak melaporkan Kesyahbandaran mengenai keberadaan kapal, c) jika ada lonjakan penumpang di pelabuhan, kapal dengan persyaratan yang belum lengkap diberangkatkan. d) masalah kelemahan sumber daya manusia (sdm). Untuk mengatasi kendala-kendala tersebut dilakukan beberapa upaya, antara lain: a) Penertiban Surat Persetujuan Berlayar (Port Clearance) secara profesional dan transparan oleh Syahbandar dan dilakukan pengawasan, b) perusahaan pelayaran harus memiliki fasilitas dan peralatan sesuai dengan ketentuan ISM Code, c) setiap kapal harus mempunyai system dan prosedur penanggulangan dan pencegahan terhadap peristiwa gangguan terhadap keselamatan (safety), d) pelaut harus memiliki Sertifikasi Kompetensi, e) menciptakan tenaga auditor yang profesional.

After the issuance of the Regulation of the Minister of Transportation of the Republic of Indonesia No. 45 of 2012, the number of ship accidents that occurred in Indonesia has decreased. This study aims (1) to determine the Article 9 of the Regulation of the Minister of Transportation No. 45 of 2012 as an effort to reduce the rate of ship accidents and (2) to identify the obstacles that occur in the application of Article 9 of the Regulation of the Minister of Transportation No. 45 of 2012 in the shipping environment. Data processing method used is qualitative data processing. Primary data obtained through interview, while secondary data obtained by literature study. The technique used to collect data is using multiple sources of evidence, namely: in-depth interviews and observation of secondary data. The results of the study are as follows: (1) one of the factors that affect the high number of ship accidents in Indonesia is human error. Therefore, the Minister of Transportation issued the Regulation of the Minister of Transportation No. 45 of 2012 on Ship Safety Management. The application of article 9 of the Regulation of the Minister of Transportation No. 45 of 2012 on Ship Safety Management shall be done by granting certificates, either DOC or SMC, and with the improvement of certification may decrease the number of ship accidents. Obstacles in the implementation of the Regulation of the Minister of Transportation No. 45 of 2012 include: a) lack of understanding from some parties in implementing the Regulation of the Minister of Transportation No. 45 of 2012 at the port and on the ship, b) many Shipowners do not report to the harbour master regarding the existence of their ships, c) when there is a sudden increase of passengers at the port, ships with deficiencies are allowed to depart , d) the incompetent human resource problem. To overcome these obstacles, several efforts were made, such as: a) professionally and transparently regulate the issuance of port clearance by harbour master and maintain control of it, b) shipping companies must have facilities and equipment in accordance with the provisions of the ISM Code, c) each ship must have system and procedures for the management and prevention againts disruption to safety, d) seafarers must have certificates of competency, e) create professional auditors.
