Justifikasi Eksistensi Peraturan Daerah Bernuansa Syariat Islam dalam Ketatanegaraan Indonesia

Penelitian ini bertujuan untuk mengetahui mengetahui justifikasi eksistensi peraturan daerah bernuansa syariat Islam di Indonesia dan untuk mengetahui eksistensi peraturan daerah (perda) bernuansa syariat Islam di Indonesia serta desain aplikasi idealnya dalam ketatanegaraan Indonesia dengan pendekatan filosofis, sosiologis dan yuridis. Penelitian ini merupakan penelitian normative yang menggali asas dan doktrin hukum sebagai landasan eksistensi peraturan daerah bernuansa syariat Islam. Hasil dari penelitian ini menunjukkan bahwa perda bernuansa syariat Islam di Indonesia sejatinya memiliki landasan pijakan yang kuat ditinjau dari teori keberlakuan peraturan perundang-undangan, meskipun pada implementasi dalam kerangka otonomi khusus dan sistem legislasi konvensional di daerah, masih terus memerlukan panduan dan pengawalan dari pemerintah pusat agar peraturan daerah yang dihasilkan dapat berjalan harmonis tanpa harus mengorbankan kelompok masyarakat tertentu.

This study aims to find out the justification of the existence of sharia regulations in Indonesia and to know the existence of sharia-based local regulations (perda) in Indonesia as well as the ideal application design in Indonesia using philosophical, sociological and juridical approach. This research is a normative research that explores the principle and legal doctrine as the foundation of the existence of syariah-based local regulations. The results of this study indicate that the sharia based local regulation in Indonesia actually has a strong foothold in terms of the enforceability theory of legislation, although the implementation within the framework of special autonomy and conventional legislation system in the region, still need guidance and guard from the central government So that the resulting local regulations can run harmoniously without having to sacrifice certain community groups.
