TINJAUAN YURIDIS KETERLIBATAN PEGAWAI NEGERI SIPIL DALAM PEMILIHAN KEPALA DAERAH SERENTAK DI PROVINSI JAMBI TAHUN 2015

Pegawai Negeri Sipil yang merupakan pelayan publik harus bersifat netral dan tidak memihak sebagaimana yang diatur dalam ketentuan Pasal 9 ayat (2) Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara yang isinya menegaskan pegawai Aparatur Sipil Negara harus bebas dari pengaruh dan intervensi semua golongan dan partai politik. Kenyataannya penerapan asas netralitas pada Pegawai Negeri Sipil saat pemiihan umum kepala daerah ternyata masih sulit terpenuhi di Provinsi Jambi. Tujuan Penelitian ini adalah Untuk mengetahui dan menganalisis tinjauan yuridis keterlibatan Pegawai Negeri Sipil dalam pemilihan Kepala Daerah serentak di Provinsi Jambi Tahun 2015 dan untuk mengetahui dan menganalisis mekanisme penanganan pelanggaran Pegawai Negeri Sipil seputar Pemilihan Kepala Daerah oleh Bawaslu dan Inspektorat Provinsi Jambi. Penelitian ini merupakan penelitian yuridis normatif dan yuridis empiris dengan pendekatan kualitatif yang bersumber pada data primer yang diperoleh melalui studi lapangan dan data sekunder melalui studi kepustakaan. Keterlibatan Pegawai Negeri Sipil dalam pemilihan Kepala Daerah serentak di Provinsi Jambi tahun 2015 khususnya pada masa kampanye secara yuridis bertentangan dengan Pasal 71 ayat (1) UU Nomor 1 Tahun 2015 tentang Penetapan Perpu Nomor 1 tahun 2014 tentang Pemilihan Gubernur Bupati dan Walikota menjadi Undang-Undang dan Pasal 5 angka 15 PP Nomor 53 Tahun 2010 tentang Peraturan Disiplin Pegawai Negeri Sipil. Terhadap pelanggaran atas Pasal 71 ayat (1) UU Nomor 1 Tahun 2015 yang dilakukan oleh PNS, Bawaslu melakukan tindakan pemeriksaan atas temuan dan atau laporan tentang pelanggaran tersebut dan menindaklanjutinya kepada Kepolisian apabila memang pelanggaran tersebut pantas untuk ditindaklanjuti. Terhadap pelanggaran Peraturan Disiplin PNS sehubungan pemilihan Kepala Daerah, Inspektorat Provinsi Jambi membentuk Tim Pemeriksa bersama Badan Kepegawaian Daerah dan atasan langsung pelanggar, setelah pemeriksaan selesai Tim Pemeriksa menyerahkan hasil pemeriksaan, BAP dan bukti-bukti pendukung kepada Pejabat yang berwenang memberikan hukuman disiplin, untuk selanjutnya Pejabat yang berwenang memberikan hukuman disiplin menjatuhkan hukuman disiplin terhadap Pegawai Negeri Sipil tersebut.

The civil servant is the public servants should be neutral and impartial as stipulated on the provisions of Article 9 paragraph (2) of Law No. 5, 2014 on the State Civil Apparatuses that confirms the official of State Civil Apparatuses should be free from the influence and intervention of all groups and political parties. In fact, the application of neutrality principle of Civil Service during general elections of regional heads it is really still difficult to fulfill in Province of Jambi This research aims to find out and analyze a juridical review of civil servant involvement on simultaneously election of Regional Head in Province of Jambi 2015 and to find out and analyze the offense handling mechanism of civil servant about the Election of Regional Head by Bawaslu (General Election Surveillance Body) and Inspectorate Province of Jambi. This research is juridical normative and juridical empiric with qualitative approach are sourced on the primary data obtained through field research and secondary data through literature studies. The civil servant involvement on simultaneously election of Regional Head in Province of Jambi 2015, particularly during the campaign is in juridical contrary to Article 71 paragraph (1) Law Number 1, 2015 on stipulation of Government Regulation Number 1 2014 on the election of Governor, Regent and Mayor to be Law and Article 5 figure 15 PP Number 53, 2010 on the Discipline Regulation of Civil Servant. Against the offense upon Article 71 paragraph (1) Law Number 1, 2015 that conducted by the Civil Servant, Bawaslu doing supervision act upon the findings and or the report on such offense and follow it up to the Police when certainly the offense is appropriate to be followed up. Against the offense of Discipline Regulation of Civil Servant in relation to the election of Regional Head, the Inspectorate of Province of Jambi established the Supervision Team in cooperation with the Regional Employment Agency and direct supervisor of the offender, after the supervision finished the Supervisor Team submit the result of supervision, BAP and supported material to the official who has authorized to take discipline punishment, and the next the authorized official give discipline punishment, decide the discipline punishment to the Civil Servant.
