PENERAPAN SANKSI ADMINISTRASI BAGI PEMBERI KERJA YANG BELUM MENDAFTARKAN PEKERJANYA MENJADI PESERTA BADAN PENYELENGGARA JAMINAN SOSIAL KESEHATAN DI KOTA YOGYAKARTA (STUDI KASUS BADAN PENYELENGGARA JAMINAN SOSIAL CABANG UTAMA YOGYAKARTA

Penulisan ini bertujuan untuk mengetahui dan menganalisis penerapan sanksi administrasi bagi pemberi kerja yang belum mendaftarkan pekerjanya menjadi peserta BPJS Kesehatan dikota Yogyakarta. Penelitian ini bersifat normatif empiris, yaitu mengkaji ketentuan hukum positif serta kenyataan dalam praktik dilapangan, dengan melakukan studi pustaka dan studi lapangan. Narasumber dalam penelitian ini yaitu BPJS Kesehatan Cabang Utama Yogyakarta, Sedangkan Responden dalam penelitian ini adalah Kepala Unit Hukum dan Komunikasi BPJS Kesehatan Cabang Utama Yogyakarta dan Kepala Unit Pemasaran BPJS Kesehatan Cabang Utama Yogyakarta yang terkait memberi informasi maupun solusi tentang permasalahan yang diteliti. Data yang diperoleh dianalisa dengan metode secara kualitatif. Hasil penelitian, dalam penerapan sanksi administrasi bagi pemberi kerja yang belum mendaftarkan pekerjanya menjadi peserta BPJS Kesehatan di kota Yogyakarta untuk saat ini BPJS Kesehatan Cabang Utama belum menjatuhkan sanksi admnistrasi ke pihak pemberi kerja. Diketahui Jumlah Perusahaan yang di Kota Yogyakarta sebanyak 2.003 dan jumlah perusahaan yang aktif atau terdaftar pada BPJS Kesehatan kurang lebih adalah 1.870. Dari semua total 133 perusahaan yang belum memenuhi kewajibannya untuk melakukan pendaftaran, Seharusnya sesuai dengan Peraturan Presiden No. 111 Tahun 2013 tentang Jaminan Kesehatan Nasional tertera di dalam peraturan tersebut batas pendaftaran paling lambat 1 januari 2015 untuk perusahaan besar, menegah dan kecil. Lewat dari tanggal tersebut seharusnya pihak BPJS Kesehatan Cabang Utama Yogyakarta menjatuhkan sanksi admnistrasi bagi pemberi kerja yang belum mendaftar menjadi peserta BPJS Kesehatan.

This writing aims to know and analyze the implementation of administrative sanctions for employers who have not registered their workers to participate BPJS Health in the city of Yogyakarta. This research is normative empirical, that is studying the provision of positive law and reality in practice field, by doing literature study and field study. The resource persons in this research are BPJS Kesehatan Branch of Yogyakarta, While Respondent in this research is Head of Legal and Communication Unit of BPJS Kesehatan of Main Branch of Yogyakarta and Head of Marketing Unit of BPJS Kesehatan of Branch of Yogyakarta which related to give information and solution about problem studied. The data obtained were analyzed by qualitative method. The results of the research, in the application of administrative sanctions for employers who have not registered their workers to be BPJS Health participant in the city of Yogyakarta for now BPJS Health Main Branch has not impose administrative sanctions to the employer. It is known that the number of companies in Yogyakarta City is 2,003 and the number of active or registered companies in BPJS Health is approximately 1,870. Of all the total 133 companies that have not fulfilled their obligations to register, It should be in accordance with Presidential Regulation no. 111 of 2013 on National Health Insurance is stipulated in the regulation of the registration limit no later than 1 January 2015 for large, medium and small companies. Through that date, BPJS Kesehatan Branch of Yogyakarta has imposed administrative sanction for the employer who has not registered to participate in BPJS Kesehatan.
