PERLINDUNGAN HUKUM KESELAMATAN DAN KESEHATAN KERJA BAGI DOKTER GIGI PADA KLINIK PRATAMA DI KABUPATEN SLEMAN

Tujuan penelitian ini adalah untuk mengetahui dan menganalisis perlindungan hukum keselamatan dan kesehatan kerja bagi dokter gigi pada klinik di Kabupaten Sleman untuk mengetahui permasalahan-permasalahan dan upaya mengatasi permasalahan dalam perlindungan hukum keselamatan dan kesehatan kerja bagi dokter gigi pada klinik di Kabupaten Sleman. Penelitian ini adalah penelitian yuridis empiris. Data yang diperoleh dari penelitian dianalisis secara kualitatif. Hasil analisis disajikan secara deskriptif. Penelitian dilakukan di Kabupaten Sleman. Teknik pengambilan sampel dalam penelitian ini menggunakan tata cara non-probability sampling. Jenis pengambilan sampel adalah purposive sampling. Hasil penelitian menunjukkan pelaksanaan perlindungan hukum keselamatan dan kesehatan kerja bagi dokter gigi pada klinik pratama di Kabupaten Sleman belum terlaksana sesuai dengan peraturan yang berlaku dan buku petunjuk yang dikeluarkan oleh Kementrian Kesehatan yang berjudul Standar Pencegahan dan Pengendalian Infeksi Pelayanan Kesehatan Gigi dan Mulut di Fasilitas Pelayanan Kesehatan. Faktor-faktor yang mempengaruhi tidak terlaksananya keselamatan dan kesehatan kerja bagi dokter gigi di klinik yaitu perilaku pada saat dokter gigi bekerja kurang berhati-hati, sehingga dapat terjadi tertusuk jarum suntik, tertusuk sonde, tertusuk alat scaller, terpeleset saat bekerja, kesetrum listrik, tidak terdaftarnya dokter gigi yang bekerja di klinik menjadi peserta BPJS, dalam atauran perusahaan pemberi kerja wajib mendaftarkan seluruh karyawannya sebagai peserta BPJS ketenagakerjaan, Tidak lengkapnya alat pelindung diri yang dimiliki oleh klinik untuk diberikan kepada dokter gigi.

The purpose of this research is to know and analyze the legal protection of safety and health working for dentist at clinic in Sleman regency. In addition, it is also to know the problems and effort to overcome the problem. This research is empirical juridical research. The data that obtained from the study were analyzed qualitatively. The results of the data analysis are presented descriptively. The study was conducted in Sleman Regency. The sampling technique that uses in this research is non-probability sampling. The type of sampling is purposive sampling. The results show that the legal protection of Occupational Safety and Health for the dentists in Pratama clinics in Sleman Regency has not been implemented in accordance with the applicable regulations and manual instruction issued by the Ministry of Health entitled Standards of Prevention and Control of Dental and Oral Health Services at Health Service Facilities. Several factors that affect the non-performance of safety and health working of the dentist in the clinic are less caution behaviors while the dentist is working, so that they can be pricked by a syringe, punctured by sonde, impaled by a scaller, slip while working, electric shock, and unregistered dentist as a member of BPJS. According to applicable regulation, the companies have to register all their employees as a member of BPJS, incomplete personal protective equipment owned by the clinic to be given to the dentist.
