Pembinaan Terpidana Mati Berstatus WNA Sebelum Eksekusi di Lapas Kelas IIA Wirogunan Yogyakarta (Studi Kasus Mary Jane)

Skripsi yang berjudul “Pembinaan Terpidana Mati Berstatus Warga Negara Asing Sebelum Eksekusi Di Lapas Kelas II A Wirogunan Yogyakarta (Studi Kasus Terpidana Mati Mary Jane Feloso) ini dilatarbelakangi karena pro dan kontra terkait pidana mati masih terus berlanjut hingga saat ini, khususnya di Indonesia yang baru melakukan eksekusi pidana mati terhadap pelaku tindak pidana narkotika. Ada dua pendapat yang muncul, yaitu bagi mereka yang setuju dan mereka yang tidak setuju dengan berbagai alasan yang mereka sampaikan berdasar pertimbangan masing-masing. Akan tetapi merupakan fakta bahwa eksekusi hukuman mati tersebut tetap berjalan bahkan hingga puluhan jumlahnya, dengan disertai tahapan-tahapan dalam proses pelaksanaannya termasuk adanya pembinaan bagi (calon) terpidana mati yang oleh sebagian kalangan dianggap tidak perlu karena menjadi pertanyaan apa tujuan dari pembinaan tersebut yang tidak sejalan dengan pembinaan pada umumnya yang bertujuan untuk mengembalikan terpidana ke arah lebih baik agar dapat kembali ke masyarakat. Menjadi pertanyaan pula bagaimana bentuk pembinaan untuk terpidana mati tersebut. Apakah ada perbedaan dengan terpidana lainnya atau tidak, dan bagaimana kaitannya dengan mereka yang berstatus Warga Negara Asing, apakah ada hak tertentu yang berbeda. Pada akhir penulisan didapat kesimpulan bahwa pembinaan terpidana mati adalah sama namun hanya beberapa mekanisme agak berbeda terkait statusnya sebagai terpidana mati. Bagi mereka yang berstatus Warga Negara Asing, terdapat hak-hak dan mekanisme pembinaan yang juga khusus untuk diberikan.

Thesis entitled "Development of Convicts Dead bullet-Foreigners Before Executions Prison Class II A Wirogunan Yogyakarta (Case Study Convicts Dead Mary Jane Feloso) was motivated because of the pros and cons related to the death penalty continues to this day, particularly in the new Indonesian carried out executions against the doers. There are two opinions that appear, to those who agree and those who disagree with various reasons they convey each based considerations. But it is a fact that executions are still running even up to tens in number, along with the stages in the implementation process, including their training for (potential) death row inmate who by some considered unnecessary because the question is what is the purpose of the guidance that is not in line with the guidance on the generally aiming to restore the convict for the better in order to be able to return to society. The question is also how the form of guidance for those on death row. Is there a difference with the other convict or not, and how it relates to their status as foreigners, are there any specific rights differently. At the end of the writing can be concluded that coaching death row is the same but only some rather different mechanisms related to its status as a death row inmate. For those with the status of foreign citizens, there are rights and mechanisms are also special guidance to be given.
