Pelaksanaan Redistribusi Tanah Pertanian Bekas Absentee di Kecamatan Bantul Kabupaten Bantul

Membagikan tanah pertanian untuk para petani penggarap merupakan salah satu cara mewujudkan cita-cita negara, yaitu kesejahteraan masyarakat. Penulisan Hukum ini bertujuan untuk mengkaji pelaksanaan redistribusi tanah di Kecamatan Bantul Kabupaten Bantul pada tahun 2016 dan faktor-faktor yang mempengaruhi pelaksanaan kegiatan tersebut. Metode yang digunakan adalah yuridis empiris yaitu dengan menggambarkan pelaksanaan yang terjadi di lapangan kemudian dikaitkan dengan peraturan yang ada. Pelaksanaan redistribusi tanah di Kecamatan Bantul Kabupaten Bantul pada tahun 2016 dilakukan dalam bentuk her-redistribusi, yaitu berupa pembuatan SK ulang atas SK redistribusi yang dinyatakan mati akibat tidak dilaksanakannya kewajiban oleh para penerima tanah. Hasil yang dicapai adalah sebanyak 90 bidang tanah yang berasal dari tanah pertanian bekas absentee telah berhasil diredistribusikan pada Desember 2016 kepada 73 petani penggarap di Desa Palbapang dan Desa Trirenggo, Kecamatan Bantul, Kabupaten Bantul. Luasan tanah yang diredistribusikan cukup sempit yaitu hanya sekitar 100-300m2 per bidang tanahnya dan masing-masing bidang tanah tersebut telah disertipikatkan berdasarkan inisiatif dari Kantor Pertanahan sebagai solusi dari masalah yang pernah timbul dalam pelaksanaan redistribusi tanah pada tahun-tahun sebelumnya.

Distributing land to the tillers is one of the way to realize the country�s goals, which is public welfare. This Legal Writing were done as to analyze the act of land redistribution in Bantul District, Bantul Regency in the year of 2016 and the factors that affect the implementation of these activities. An empirical juridical method has been used in which the author describes the excecution happens on the field and then associated with the existing regulations. The act of land redistribution in Bantul District, Bantul Regency in the year of 2016 carried out in the form of her-redistribution, which is renewing the old documents that had died as a result of violation over the obligations by those people who had received the land. The results are as many as 90 areas of farmland has been successfully redistributed in December 2016 to 73 peasants in Palbapang and Trirenggo Village, Bantul District, Bantul Regency. The area of the land that had been redistributed is only about 100-300m2 per plot and each plot has been registered by the initiative of the Land Office as the solution of the problems that ever happened in the act of land redistribution in the previous years.
