TINJAUAN YURIDIS PENYERAHAN OBAT OLEH TENAGA TEKNIS FARMASI DI RSUD KABUPATEN MUNA

Tujuan dari Penelitian ini adalah untuk mengetahui aspek yuridis penyerahan obat oleh tenaga teknis farmasi dalam pelayanan farmasi di RSUD Kabupaten Muna berdasarkan Peraturan Menteri Kesehatan nomor 58 Tahun 2014 tentang Standar Pelayanan Farmasi di Rumah Sakit. Metode penelitian menggunakan pendekatan yuridis-empiris. Pendekatan secara yuridis adalah pendekatan dari segi peraturan perundang-undangan dan norma-norma hukum dengan cara penelitian kepustakaan, sedangkan pendekatan empiris dengan jalan terjun langsung ke objek penelitian yang berupa tinjauan yuridis penyerahan obat oleh tenaga teknis farmasi di Rumah Sakit Umum Daerah Muna.Lokasi penelitian adalah Rumah Sakit Umum Daerah Muna, Kabupaten Muna, Propinsi Sulawesi Tenggara. Hasil penelitian menunjukkan bahwa tinjauan yuridis penyerahan obat oleh tenaga teknis farmasi di RSUD Muna adalah bahwa Perlindungan hukum pada Tenaga teknis Farmasi di instalasi farmasi sangat lemah karena cara pelayanan yang salah dan tidak memperhatikan kode etik maupun peraturan yang berlaku sehingga terjadi ketimpangan tanggung jawab dan wewenang penyerahan obat dalam instalasi farmasi karena tumpang tindih pelayanan antara apoteker dengan tenaga teknis farmasi. Selain itu juga adanya pelimpahan wewenang yang salah dari apoteker pada tenaga teknis farmasi, hal tersebut sangat membahayakan jiwa pasien karena berhubungan dengan keselamatan mereka. Pihak rumah sakit belum menyadari bahwa pelimpahan kewenangan bukan berarti pelimpahan tanggung jawab sebab apoteker adalah pihak yang berwenang dalam penyerahan obat bukan tenaga teknis farmasi.

The purpose of this study was to determine the juridical aspects of the delivery of drugs by pharmaceutical technical personnel in pharmacy services in hospitals Muna. The research method of juridical-empirical approach. Juridical approach is an approach in terms of legislation and legal norms by means of research literature, whereas the empirical approach to the road go directly to the object of research in the form of reviews juridical delivery of drugs by pharmaceutical technical personnel at the General Hospital of Muna.The research location is the Regional General Hospital Muna, Muna, Southeast Sulawesi Province. The results showed that the judicial review of drug delivery by technical personnel at the hospital pharmacy Muna are as follows Legal protection for patients, especially dri pharmacy is very weak because of the way the service is wrong and does not pay attention to the code of ethics and regulations, The imbalance of responsibility and authority in the drug delivery pharmacy services because of the overlap between pharmacists with pharmaceutical technical personnel, The existence of devolution is one of the pharmacist in pharmaceutical technical personnel, it is so endanger the lives of patients because they relate to their safety. The hospital had not yet realized that the delegation of authority does not mean devolution of responsibility because the pharmacist is the authorities in the delivery of pharmaceutical drugs are not technical personnel.
