Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis proses penyusunan dan hambatan implementasi Peraturan Daerah (Perda) Kabupaten Kutai Kartanegara (Kukar) Nomor 10 Tahun 2013 Tentang Tanggung Jawab Sosial Perusahaan (TJSP). Penelitian ini dilatar belakangi oleh belum terimplementasinya Perda yang dimaksud. Padahal Perda tersebut diperlukan oleh Pemda Kukar untuk memberikan kepastian dan perlindungan hukum atas pelaksanaan program TJSP di Kukar. Selain itu juga untuk memberikan arahan kepada semua perusahaan dan semua pemangku kepentingan (stakeholder) yang ada di Kukar atas pelaksanaan program dan bidang kerja TJSP yang sinergis dengan program pembangunan daerah. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian kualitatif dengan pendekatan deskriptif dan untuk penentuan informannya penelitian ini menggunakan teknik purposive sampling dan snowball sampling, dengan tiga teknik pengumpulan data yang digunakan yaitu observasi, wawancara dan dokumentasi. Dari penelitian yang dilaksanakan, maka diperoleh beberapa hasil. Pertama bahwa Perda tersebut merupakan Perda inisiatif dari DPRD Kukar, tak mengherangkan jika Perda tersebut mendapatkan dukungan penuh dari Anggota DPRD Kukar periode 2009-2014, sehingga dalam proses penyusunannya tidak mendapatkan hambatan/persoalan yang cukup mengganggu. Kedua, Perda tersebut lebih bersifat elitis, yang ditandai dengan adanya dominasi pihak eksekutif dan legislatif dalam proses penyusunannya, sementara partisipasi masyarakat sangat minim bahkan tidak ada dalam penyusunan Perda tersebut. Ketiga, terdapat 4 hal yang menghambat implementasi dari Perda yang dimaksud, yaitu: (1). sosialisasi Perda yang kurang optimal kepada masyarakat dan pihak terkait; (2). belum keluarnya Peraturan Bupati Kukar untuk menindaklanjuti pelaksanaan teknis Perda yang dimaksud; (3). ketidakjelasan pembentukan Forum TJSP Kukar; (4). Masuknya Perda yang dimaksud dalam Program Legislasi Daerah (Prolegda) 2015, sebagai salah satu Perda yang direvisi. Keempat, belum terlaksananya Perda tersebut, berdampak pada belum terjadinya sinergitas yang baik atas rencana pembangunan daerah dengan pelaksanaan program CSR perusahaan yang beroperasi di Kukar.

This study aims to describe and analyze the process of drafting and implementation obstacle on Regional Regulation (Perda) in Kabupaten Kutai Kartanegara (Kukar) Number 10 Year 2013 About the Corporate Social Responsibility (CSR). This research was driven by the case that the regulation is not implemented. However, these regulations are important for the Government of Kukar to provide certainty and legal protection for the implementation of CSR programs in Kukar. It is also to provide guidance to all companies and all stakeholders (stakeholders) in Kukar on the implementation of the program and the work areas of CSR that is synergistic with regional development programs. The method of research used in this study is a qualitative research method with descriptive approach. Researcher chooses this approach to the determination of their informants. The study conducted with purposive sampling and snowball sampling, with three data collection techniques used were observation, interviews and documentation. From the research analysis, the study obtained some results. First that the laws is an initiative of the Kukar Council Regulation. It is not surprising that the regulation get full support from Members of Kukar Parliament 2009-2014 period, resulting in the drafting process did not get obstacles. Second, the law does more elitist, which is characterized by the dominance of the executive and legislature in the drafting process, while community participation was low even absent in drafting the regulation. Third, there are four things that hinder the implementation of the legislation in question, namely: (1). Regulation is less than optimal socialization to the public and other interested parties; (2). yet the regulations of the Regent Kukar to follow up the implementation of the technical regulation in question; (3). CSR Forum Kukar obscurity formation; (4). The entry of the legislation referred to in the Regional Legislation Program (Prolegda) in 2015, as one of the revised legislation. Fourth, the laws does not implemented yet and have an impact on good synergy between regional development plan with the implementation of CSR programs companies operating in Kukar.
