INTISARI Tinjauan Sosiologi Kriminal Mengenai Dampak Pemidanaan Bagi Mantan Narapidana di Yogyakarta Penelitian ini bertujuanuntuk memberikan penjelasan dan analisis mengenai persepsi masyarakat terhadap keberadaan mantan narapidana di tengah kehidupan masyarakat dan juga persepsi maupun pengalaman mantan narapidana pasca menjalani pemidanaan di tengah kehidupan masyarakat, serta untuk mengetahui bagaimana peran negara dalam upaya menghapuskan label pada diri mantan narapidana. Penelitian dilakukan dengan menggunakan teknik purposive sampling. Alat penelitian menggunakan wawancara untuk menentukan responden mantan narapidana dan responden masyarakat. Setelah itu, dilakukan wawancara kepada Lembaga Pemasyarakatan, Balai Pemasyarakatan, dan Polda DIY. Setelah seluruh data terkumpul, maka data-data yang diperoleh dilakukan analisa dengan menggunakan metode analisa deskriptif kualitatif. Hasil Penelitian menunjukkan bahwapersepsi masyarakat mengenai mantan narapidana terdiri dari dua perspektif, yaitu perspektif masyarakat setingkat Ketua RT/RW mengenai sikap masyarakat terhadap mantan narapidana yang pada umumnya mau menerima kembali mantan narapidana dalam lingkungan masyarakat dan dalam perspektif masyarakat di sekitar mantan narapidana yang menunjukkan sikap terbuka dan menerima keberadaan mantan narapidana, yang ditunjukkan melalui reaksi-reaksi positif dari masyarakat, sehingga label penjahat/mantan narapidana secara umum tidak menjadi masalah bagi masyarakat selama ada perubahan sikap dari mantan narapidana. Dalam persepsi mantan narapidana pada umumnya merasa diterima dan dihargai oleh masyarakat di sekitarnya atas adanya sikap dan reaksi masyarakat yang positif dan dalam pengalamannya setelah selesai menjalani pemidanaan, mantan narapidana terlibat dalam kegiatan sosial kemasyarakatan, mencari pekerjaan dan kegiatan sosial lainnya, serta bekerja secara wirausaha dan tidak membutuhkan SKCK sebagai syarat untuk bekerja. Upaya negara dalam menghapus label pada diri mantan narapidana telah dilaksanakan melalui institusi penegak hukum terkait, masing-masing dengan menyesuaikan tugas pokok dan fungsinya serta kendala-kendala yang ada, termasuk keberadaan SKCK yang menghambat mantan narapidana untuk memperoleh pekerjaaan yang lebih baik, sekaligus menghambat tujuan negara untuk memperbaiki diri mantan narapidana dalam rangka menghapus label penjahat pada diri mantan narapidana. ABSTRACT The Criminal Sociology Review of the Effect of the Punishment to the Ex-Convicts in Yogyakarta This research aims to provide an explanation and analysis about the public perceptions of the presence of the ex-convicts in thesocial life and also their perception and experience of the ex-convicts after the undergoing punishment, and to know how the state's role in eliminating the labels on theex-prisoners. Research is done by using purposive sampling technique. The Research use interviews to determine the ex-convict respondents and the public respondents. After that, the interview is done to the Prison, Correctional Centres, and Polda DIY. After all the data have been collected, then it is analyzed by using qualitative descriptive analysis. The Research shows that the people's perceptions toward the ex-convictsconsistsof two perspective. The first perspective comes fromthe neighborhood leader and commune leader regarding to the public attitudes towards ex-prisoners who are generally have willingness to accept the return of the ex-convicts in the society. The second perspective comes from the people around the ex-convicts who showed the inclusive reaction and acceptance to the the presence of the ex-convicts, which is indicated by the positive reactions from the society so that the criminals label / ex-convict are generally not a problem for the society as long as they show an attitude improvement. Based on the ex-convictsperception, they feel accepted and appreciated by the society because there is a positive reaction by the people and the experience after completion the undergo punishment. The ex-convicts are involved in social activities, employment and other social activities, as well as the work of entrepreneurs and SKCK are not required as a condition for work. The effort of the state in removing the labels on the ex-convict has been implemented through the law enforcement agencies.it can be done by adjusting the duties andits functions and also the exist constraints including the existence of SKCK that hinder former inmates to obtain employment better, while inhibiting the destination countries to improve the ex-convict in order toremovethe label on the ex-convict criminals.
