KEDUDUKAN BALAI PEMASYARAKATAN (PEMBIMBING KEMASYARAKATAN) DALAM PROSES DIVERSI PADA TAHAPAN PRA-AJUDIKASI (Studi Kasus Balai Pemasyarakatan Klas IIa Ambon)

Penelitian ini bertujuan untuk mengetahui implementasi tugas dan fungsi Pembimbing Kemasyarakatan dalam proses diversi pada tahapan pra-ajudikasi dan untuk menganalisis faktor-faktor penghambat tugas dan fungsi Pembimbing Kemasyarakatan dalam proses diversi pada tahapan pra-ajudikasi di daerah Maluku. Metode penelitian yang digunakan adalah metode penelitian hukum normatif dan empiris. Pada penelitian hukum normatif dilakukan penelitian bahan kepustakaan yang berkaitan dengan Balai Pemasyarakatan, Pembimbing Kemasyarakatan, Diversi, Sistem Peradilan Pidana Anak. Kemudian dilakukan penelitian hukum empiris yakni penelitian terhadap data primer melalui wawancara langsung kepada narasumber yang berkompeten dan terkait dengan masalah yang akan diteliti antara lain dari pihak Balai Pemasyarakatan Klas IIa Ambon, Penyidik Kepolisian Polres Seram Bagian Barat dan Polsek Leksula, pengamat Sistem Peradilan Pidana Anak. Data yang diperoleh kemudian diolah dengan menggunakan metode deskriptif preskriptif. Berdasarkan hasil penelitian, disimpulkan bahwa ketidaksiapan para penegak hukum mempengaruhi tugas dan fungsi Pembimbing Kemasyarakatan di Balai Pemasyarakatan Klas IIa Ambon pada tahapan Pra-Ajudikasi sehingga asas kepentingan terbaik bagi anak tidak terpenuhi. Hal ini dikarenakan Pertama, kurangnya sosialisasi pemberlakuan diversi kepada sub-sistem peradilan anak di daerah pelosok . Kedua, tidak dimilikinya Penyidik Anak oleh pihak kepolisian di daerah pelosok di Maluku sehingga berimplikasi terhadap kurangnya pengetahuan penyidik kepolisian akan pemberlakuan diversi. Ketiga, kurangnya sarana dan prasarana penunjang di daerah-daerah pelosok seperti: Transportasi, Jaringan Telefon dan Listrik yang mempengaruhi mobilitas dan kinerja sub-sistem peradilan anak di Maluku. Dimasa yang akan datang perlu adanya kesiapan sarana dan pra sarana penunjanglembaga pengawasan baik itu bersifat fungsional maupun internal dalam hal mengawasi jalannya penyelesaian perkara anak. Lebih ditingkatkan dan ditegakan sanksi administratif.

This study aims to determine the implementation of roles and functions of the Community Advisor in the diversion process of the pre-adjudication step and to analyze the factors inhibiting the duties and functions of the Community Advisor in the diversion process in the pre-adjudication step in the Moluccas.. The method used is a normative legal research and an empirical legal research. In the normative legal research, it was served the materials research literature pertaining to the Correctional Centers, the Community Advisors, the Diversion, and the Juvenile Justice System. Then, it was served the empirical legal research that research on primary data through interviews to speakers who were competent and related issues to be examined, among others: from the Community Advisor Class IIa Ambon, Investigator Police in West Seram, Leksula police, and the observers juvenile justice system. The data obtained were processed using descriptive and prescriptive method. Based on the results of the study concluded that the unpreparedness of the law enforcement affect the duties and functions of the Community Advisor in the Penitentiary Centers Class IIa Ambon in Pre-adjudication step so the principle of interest best for children are not met. This is because First, lack of the socialization enforcement of the diversion to the sub-system of juvenile justice in remote areas. Second, it does not have the Son by the police investigators in the remote areas in Maluku. so the implications for the lack of knowledge of the law enforcement agencies, will be the implementation of diversion. Third, the lack of facilities and infrastructure in the remote areas such as: Transport, Network and Electrical Telephone affecting mobility and performance sub-system of juvenile justice in Maluku,. In the future, it is needed for better oversight agency that is both functional or internally in terms of overseeing the child’s setting disputes. Further improved if the administrative sanctions.
