PENGUASAAN DAN PEMANFAATAN TANAH BEKAS OKUPASI TENTARA JEPANG DI DESA SOBOKERTO, KECAMATAN NGEMPLAK, KABUPATEN BOYOLALI Samuel Aditya Raharjo , Sulastriyono INTISARI Tujuan yang ingin dicapai dalam penelitian ini adalah untuk mengetahui dan menganalisis sejarah penguasaan dan pemanfaatan tanah bekas okupasi tentara jepang tersebut, serta mengetahui kendala-kendala apa saja yang dihadapi para pihak yang berkonflik dalam menguasai dan memanfaatkan tanah bekas okupasi tentara jepang tersebut dan upaya yang sudah dilakukan untuk mengatasi kendala penguasaan dan pemanfaatan tanah bekas okupasi tentara jepang tersebut. Penelitian ini adalah penelitian hukum empiris yang bersifat deskriptif. Lokasi penelitian adalah di Desa Sobokerto, Kecamatan Ngemplak, Kabupaten Boyolali, Provinsi Jawa Tengah. Data penelitian berupa data primer yang didapatkan dengan metode wawancara dan data sekunder yang didapatkan dengan studi kepustakaan. Responden dalam penelitian ini adalah Kepala Desa Sobokerto, ahliwaris 41 Kepala Keluarga warga bekas dukuh polokarto, Kepala Seksi Sengketa, Konflik, Perkara Pertanahan (SKP) Badan Pertanahan Kabupaten Boyolali, dan Kepala Bagian Hukum TNI AU Adi Soemarmo, sedangkan narasumber dalam penelitian ini adalah Ketua Tim Kemenangan Tanah Sengketa Polokarto dari Pemerintah Desa Sobokerto. Data penelitian dianalisis secara kualitatif, untuk menarik kesimpulan digunakan metode berpikir induktif. Hasil penelitian sejarah penguasaan dan pemanfaatan tanah bekas okupasi tentara Jepang di Desa Sobokerto, Kecamatan Ngemplak, Kabupaten Boyolali diawali sejak sebelum tahun 1943 atau sebelum penjajahan Jepang yang sampai dengan saat ini belum mendapat penyelesaian siapa yang berhak atas tanah tersebut. Sampai dengan saat ini penguasaan dan pemanfaatan tanah bekas okupasi tentara Jepang tersebut masih dimanfaatkan oleh para pihak yang berkonflik. Penguasaan tanah bekas okupasi tentara Jepang tersebut secara de facto masih dikuasai oleh Pemerintah Desa Sobokerto dan TNI AU Adi Soemarmo. Pemanfaatan tanah bekas okupasi tentara Jepang tersebut oleh TNI AU Adi Soemarmo memanfaatkan tanah tersebut untuk latihan perang, Pemerintah Desa beserta masyarakat Desa Sobokerto memanfaatkan tanah tersebut untuk area bercocok tanam, arena olahraga, pemakaman umum. Kendala yang dihadapi oleh para pihak yang berkonflik adalah sulitnya menyatukan keinginan dari masing-masing pihak yang bersengketa. Upaya yang telah dilakukan para pihak yang berkonflik untuk menyelesaikan kendala tersebut adalah dengan cara melakukan perundingan untuk mencapai kesepakatan dalam penyelesaian tanah bekas okupasi tentara Jepang tersebut.

THE AUTHORITY AND BENEFICIAL OF THE LAND EX-JAPANESE ARMY OCCUPATION IN SOBOKERTO VILLAGE, NGEMPLAK DISTRICT, BOYOLALI Samuel Aditya Raharjo , Sulastriyono ABSTRACT The goal of this research is to investigate and analyze the history of the authority and beneficial of the land ex-Japanese army occupation, as well as knowing the constraints of what is facing conflicting parties in the authority and beneficial of the land ex-Japanese army occupation and the efforts that have been done to overcome the constraints of the authority and beneficial of the land ex-Japanese army occupation. This research is a descriptive empirical law. This research is held in the village of Sobokerto, District Ngemplak, Boyolali, Central Java Province. The primary data obtained by interview and secondary data obtained with the study of literature. Respondents in this study were the village chief Sobokerto, heirs 41 heads of family of the former hamlet Polokarto, Head of Section of Dispute, Conflict, Case Land (SKP) National Land Office of Boyolali, and Legal Department Air Force Adi Soemarmo, while resource person in this study is the Chairman team victory Land Dispute Sobokerto Polokarto of the village government. Data were analyzed qualitatively, to draw conclusions used method of inductive thinking. The results of this research the authority and beneficial of the land ex-Japanese army occupation in the village of Sobokerto, District Ngemplak, Boyolali started since before 1943 or before the Japanese occupation until now has not received the settlement who is entitled to the land. Until now the authority and beneficial of the land ex-Japanese army occupation are still used by the conflict parties. The authority of the land ex-Japanese army occupation, still under controlled by the village government Sobokerto and the Air Force Adi Soemarmo. The Air Force Adi Soemarmo used the land for war exercise, along with the villagers of village government Sobokerto used the land for farming areas, sports arenas, public cemetery. Constraints faced by the parties in conflict is the difficulty of uniting the desire of each party to the dispute. Efforts have been made conflicting parties to resolve these problems is to conduct negotiations to reach agreement in settlement of former land occupation of the Japanese army.
