KONFLIK SAMPANG DALAM KEBEBASAN BERAGAMA DAN UPAYA PROSES LITIGASI

Tujuan penelitian ini untuk mengetahui (1) hak mengajukan proses litigasi oleh kelompok penganut syiah dan (2) perlindungan hukum yang diberikan oleh negara terhadap kelompok penganut syiah Penelitian ini menggunakan metode penelitian normatif empiris, yaitu berdasarkan fakta dan data hukum yang dapat langsung dari lapangan. Penelitian ini dilakukan untuk mendapatkan data primer yang berkenaan dengan hal-hal yang ada dilapangan melalui wawancara langsung dengan responden dan narasumber. Jadi data yang diperoleh dianalisa dengan cara memadukan bahan-bahan hukum primer dan sekuder yang diperoleh dari lapangan. Hasil penelitian ini menunjukkan bahwa (1) kelompok penganut Syiah di Sampang sudah melakukan upaya hukum untuk mendapatkan hak-hak mereka tetapi sebagai kelompok yang dianggap minoritas terdapat banyak pengabaian penegak hukum dalam memberikan perlindungan hukum. Kelompok penganut Syiah sudah melapor kepada pihak kepolisian Sampang terkait dengan penyerangan oleh masyarakat tetapi pihak kepolisian Sampang tidak pernah merespon laporan dari kelompok Syiah; dan (2) untuk menghidari kembali terjadinya konflik terhadap kelompok penganut Syiah pemerintah Kabupaten Sampang sudah bekerja sama dengan Pemerintah Provinsi Jawa Timur untuk memindahkan kelompok penganut Syiah ke rusun puspa agro jimondo Sidoarjo. Untuk menghidupi kebutuhan sehari-hari pemerintah Provinsi Jawa Timur memberikan subsidi berupa uang bulanan dan mereka dipekerjakan sebagai buruh harian.

The aims of the study are to discover (1) the right to submit litigation process by a group of Shia followers and (2) the legal protection provided by the State to a group of Shia followers. The study uses method of empirical normative research, which is based on the fact and legal data obtained directly from the field. The study conducted to obtain primary data related to the things around the field through direct interviews with respondents and informants. Thus, the data obtained were analyzed by combining primary and secondary legal materials from the field. The result of the study shows (1) A group of Shia followers in Sampang has been tried to seek legal effort to get their right. However, as a group considered as a minority, there are a lot of neglect of law enforcement in providing legal protection. A group of Shia followers has been reported to the police in Sampang related to the society attact, however, the police team in Sampang never gives any response to the report of Shia group; and (2) to avoid the re-occurrence conflict against a group of Shia followers, the government of Simpang has been working with the government of East Java Province to resettle a group of Shia followers into flat of puspa agro jimondo in Sidoarjo. To fulfill the daily needs, the government of East Java Province provides subsidies in the form of monthly allowance and that goup of Shia followers hired as day laborers.
