PERLINDUNGAN HUKUM TERHADAP AHLI WARIS TESTAMENTER WNI KETURUNAN TIONGHOA DALAM SURAT WASIAT YANG TIDAK TERDAFTAR PADA PUSAT DAFTAR WASIAT UNTUK KEPENTINGAN PEMBUATAN AKTA KETERANGAN HAK MEWARIS OLEH NOTARIS

Tujuan penelitian ini mengetahui dan menganalisis akibat hukum, dan Perlindungan Hukum bagi ahli waris testamenter WNI Keturunan Tionghoa dalam surat wasiat yang tidak terdaftar pada Pusat Daftar Wasiat, serta sanksi terhadap Notaris yang lupa mendaftarkan wasiat melalui sistim AHU Online. Penelitian ini menggunakan jenis penelitian yuridis normatif, yang dilakukan dengan cara menelaah data sekunder, dengan bahan penelitian yang diperoleh dari bahan pustaka melalui perpustakaan, dokumen-dokumen, peraturan perundang-undangan dan tulisan-tulisan lain yang ada hubungannya dengan permasalahan dengan cara mengumpulkan data menggunakan metode dokumenter serta alat pengumpulan data studi dokumenter dan dianalisis secara kualitatif. Hasil penelitian pada permasalahan yang pertama, menunjukan akibat hukum tidak terdaftarnya wasiat, maka secara administratif wasiat yang pernah dibuat (jika ada wasiat) menjadi tidak terdaftar, walaupun pendaftaran/pelaporan wasiat ke Pusat Daftar Wasiat bukan merupakan syarat sahnya wasiat namun, jika hasil pengecekan dari Pusat Daftar Wasiat menyatakan bahwa wasiat tersebut "tidak terdaftar" maka nama calon ahli waris testamenter WNI Keturunan Tionghoa tidak akan tercatat dalam Akta Keterangan Hak Mewaris (AKHW). Perlindungan hukum terhadap ahli waris testamenter WNI Keturunan Tionghoa dapat berupa perlindungan secara preventif dan represif, secara preventif Notaris wajib benar-benar memastikan bahwa wasiat yang dibuat oleh/dihadapannya telah dilaporkan/ didaftarkan ke Pusat Daftar Wasiat guna mencegah masalah yang timbul di kemudian hari, sedangkan secara represif, calon ahli waris testamenter WNI Keturunan Tionghoa dapat mengajukan gugatan ke Pengadilan apabila merasa dirugikan akibat tidak terdaftarnya wasiat yang pernah dibuat oleh pewaris. Apabila ada Notaris yang lupa mendaftarkan wasiat milik pewaris dan menimbulkan kerugian bagi ahli waris testamenter maka ahli waris testamenter WNI Keturunan Tionghoa dapat melakukan gugatan kepada Notaris secara perdata.

The purpose of this study to know and analyze the legal consequences, and legal protection of Indonesian Citizens Chinese descent testamentery heirs in the will that is not listed in Center List of Testament, as well as sanctions against notaries who forgot to register a will through Online AHU system. This research uses normative juridical, which is done by examining secondary data, with the research material obtained from library materials through the library, documents, legislation and other writings that have to do with the problem by collecting data using documentary methods and documentary study data collection tools analyzed qualitatively. Results of the research on the first problem, shows the legal consequences of the not registered will, administratively a will that is ever made (if there is a will) become unregistered, although registration / reporting testament to the Testament List Center is not a valid requirement of a will, but, if the results of checking the Testament List Center states that a will is "unregistered" then the candidate name of the Indonesian Citizens Chinese descent testamentery heirs will not be recorded in the Deed Description of Inheriting Rights (AKHW). Legal protection of the Indonesian Citizens Chinese descent testamentery heirs may be preventive and repressive. Preventively, Notaries are required to make absolutely sure that a will made by / in front of them have been reported / registered to the Testament List Center to prevent problems arising in the future, while repressively, candidate of Indonesian Citizens Chinese descent testamentery heirs can file a lawsuit to the Court if they feel disadvantaged by the unregistered will made by the testator. If there is a notary who forget to register a will of testator and cause harm to the testamentery heirs, then Indonesian Citizens Chinese descent testamentery heirs can file a civil lawsuit to the Notary.
