Telaah Filosofis Terhadap Nilai - Nilai Dasar Profesi Dalam Kode Etik Notaris Sebagai Upaya Meningkatkan Profesionalisme Notaris

Profesi Notaris merupakan profesi yang luhur dan lekat dengan sisi kemanusiaan. Notaris wajib menjalankan tugasnya secara etis dan profesional. Untuk mencapai hal tersebut, setiap Notaris perlu memiliki pemahaman yang mendalam mengenai nilai-nilai dasar profesi yang terkandung dalam kode etik profesinya. Penelitian ini bertujuan untuk mengetahui, mendeskripsikan, dan menganalisis secara filosofis bagaimana penjabaran nilai-nilai dasar profesi dalam Kode Etik Notaris sebagai salah satu upaya untuk meningkatkan profesionalisme Notaris. Penelitian ini adalah penelitian hukum normatif. Data yang dipergunakan dalam penelitian berupa data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Data sekunder dikumpulkan melalui studi kepustakaan dan dianalisis secara deskriptif kualitatif. Keseluruhan bahan hukum baik primer, sekunder, maupun tersier tersebut diolah dengan melakukan kategorisasi sebagai pengklasifikasian bahan hukum secara selektif. Penarikan kesimpulan dilakukan dengan penalaran secara deduksi. Hasil penelitian menunjukkan bahwa profesi Notaris erat dengan nilai-nilai luhur yang bersifat abstrak sehingga untuk mencegah ketimpangan perlu diikuti dengan pemahaman yang mendalam mengenai etika profesi yang tertuang pada Kode Etik Notaris. Nilai-nilai dasar profesi berupa nilai kesakralan, nilai solidaritas, nilai teoritis, nilai kekuasaan, nilai ekonomi, serta nilai keterampilan yang sifatnya abstrak telah dijabarkan di dalam pasal-pasal Kode Etik Notaris. Nilai-nilai tersebut saling terkait dan sama pentingnya untuk diimplementasikan saat Notaris menjalankan tugas maupun dalam kehidupan sehari-harinya guna mencapai hakekat dan tujuan profesi Notaris sebagai profesi yang luhur.

Profession of notary as a nobile officium is closely related to humanity. Notary is required to be responsible of his profession both ethically and professionally. In order to do that, every Notary should have a deeper understanding on the core value of profession which is defined in Notary Code of Ethics. The study was aimed to recognize, describe and conduct philosophical analysis on how the core value of profession is defined in Notary Code of Ethics as one of the efforts to improve Notary professional conducts. The study was a normative legal research. The data consisted of secondary data which can be classified as primary legal data, secondary legal data, and tertiary legal data. Secondary data were obtained from literature study which were then used in descriptive qualitative analysis. All the primary, secondary and tertiary legal data were categorized to make the classification of legal material selectively. The conclusion was deductively obtained based on the logical thought. The result of the study shows that profession of notary as a nobile officium deals with norms so that deeper understanding on profession ethical codes as written in Notary Code of Ethics is essential to maintain impartiality. The core value of profession, namely sacred value, solidarity value, theoretical value, power value, economical value, and skill value, has been defined in the articles of Notary Code of Ethics. Those values are related and has the same importance to be implemented by notaries when conducting their responsibilities or in daily life to achieve the nature and purpose of notary profession as nobile officium.
