Penelitian bertujuan untuk mengetahui dan menganalisis kedudukan hukum akta notaris yang bersifat simulasi dari perspektif kitab undang-undang hukum perdata dan implikasi yuridis atas perjanjian simulasi yang dibuat dengan akta notaris. Penelitian yang bersifat yuridis normatif, menggunakan metode pendekatan undang-undang (statue approach), pendekatan konsep (conseptual approach) serta pendekatan kasus (case approach) Berdasarkan hasil penelitian dapat disimpulkan bahwa pertama, tujuan pembuatan jual beli dihadapan notaris dengan maksud sebagai pemberian jaminan atas hutang. syarat obyektif dalam Pasal 1320 KUHPerdata mengenai sebab yang halal adalah batal demi hukum dan tidak mempunyai kekuatan hukum sehingga tidak mengikat bagi para pihak atas substansi akta. Kedua, batal demi hukum artinya sejak awal dianggap tidak pernah ada perjanjian maka segala perbuatan hukum terjadi kembali seperti semula.

legal research aims to determine and analyze the legal position of notarial deed which is a simulation of perspektive the statue book of civil law, and the implication juridical on agreements simulation created by deed notary public.This research is a normative juridical, Using the method of approach legislation (approach statue), approach the concept (conceptual approach), as well as the approach of the case (approach case).Based on the results of research and discussion can be concluded that, firstly, the objective of making the agreement binding sale and purchase before a notary with the intention of giving collateral for debt. Objective requirements of Article 1320 of the statue books of civil law regarding lawful cause is null and void and not legally so it is not binding for the parties on the substance of the deed which is based on the principle of honesty and good faith in the pre agreement.
