Konsep ASEAN Way pada Sistem Penyelesaian Sengketa di ASEAN: Studi Kasus Sengketa Candi Preah Vihear antara Kamboja dengan Thailand

Beberapa kritik menilai bahwa ASEAN Way merupakan kedok ASEAN untuk tidak bertindak ketika negara anggotanya sedang menghadapi sebuah sengketa. Tulisan ini membahas bahwa konsep ASEAN Way dapat digunakan dalam manajemen sengketa dan juga dapat digunakan untuk mengarahkan dinamika sengketa menuju sebuah penyelesaian. Pada sengketa Candi Preah Vihear, terdapat beberapa norma dalam ASEAN Way yang tercermin dalam dinamika sengketa. Meskipun begitu, terdapat beberapa norma yang dilanggar oleh negara-negara yang terlibat dalam sengketa seperti pelanggaran integritas teritorial. Sengketa ini juga menguji prinsip non-intervensi dalam proses penyelesaian sengketa oleh ASEAN serta bagaimana organisasi regional ini menjalankan mekanisme good offices yang tercantum dalam Treaty of Amity and Cooperation in Southeast Asia sebagai salah satu jalur damai pada sistim penyelesaian sengketa di ASEAN.

Some critics considered that ASEAN Way is a cover for inaction when member states are facing a dispute. This paper discusses the use of ASEAN Way concept in the management of disputes and can also be used to direct the dynamics of the dispute towards a settlement. In the dispute over the Preah Vihear temple, there are some norms in ASEAN Way that reflected in the dynamics of the dispute. Even so, there are norms that were violated by the countries involved in the dispute as the dispute itself was a violation of territorial integrity. This dispute has also tested the principle of non-intervention in the dispute resolution process by ASEAN as well as how the regional organization is running a good offices mechanism listed in the Treaty of Amity and Cooperation in Southeast Asia as one of the pacific dispute settlement system in ASEAN.
