CONSUMER PROTECTION IN E-COMMERCE TRANSACTIONS: AN ANALYSIS OF THE CONSUMER PROTECTION RIGHTS IN E-COMMERCE IN INDONESIA AND THE UNITED NATIONS GUIDELINES ON CONSUMER PROTECTION

Penggunaan e-commerce di Indonesia telah meningkat secara signifikan dalam beberapa tahun terakhir, dimana setiap hari nya hampir semua orang dapat menikmati penggunaan e-commerce secara langsung tanpa harus beranjak dari tempat tinggal mereka. Munculnya aktivitas e-commerce kemudian datang dengan pertanyaan apakah peraturan di Indonesia, dalam hal hukum perlindungan konsumen cukup untuk menangani pertumbuhan tersebut. Dengan demikian, penting untuk menganilisis peraturan saat ini tentang perlindungan konsumen dalam e- commerce di Indonesia untuk menentukan efektivitas dalam melindungi hak-hak konsumen. Penelitian hukum ini dilakukan melalui pendekatan normative, dengan menggunakan studi pustaka untuk menjawab permasalahan hukum, di mana penulis menggunakan buku, jurnal, artikel dan sumber-sumber lain yang mendukung penilitan hukum ini, di bidang perlindungan konsumen di dalam e-commerce. Hasil penelitian hukum ini menunjukkan bahwa perlindungan hak-hak konsumen dalam kegiatan e-commerce di Indonesia masih kurang. Hukum perlindungan konsumen di Indonensia hanya mencakup perdagangan secara konvensional atau secara offline sedangkan perdagangan online belum disebutkan. Selain itu, undang-undang perlindungan konsumen Indonesia lebih berfokus pada konsumen daripada para bisnis, yang juga dianggap penting dalam kegiatan e- commerce.

The usage of e-commerce in Indonesia has increased significantly the past few years, where almost everyone can enjoy the usage of e-commerce right from the comfort of their home. The rise of e-commerce activity then comes with the question whether the regulations in Indonesia, in regards to the consumer protection law is enough to handle such growth. Thus, it is important to analyze the current regulations on consumer protection in e-commerce in Indonesia to determine its effectiveness in protecting the rights of consumers. This legal research is conducted through a normative approach, using library research in order to answer the legal problems, where the author uses books, journals, articles and other sources that support this legal research, in the field of the protection of consumers in e-commerce. The result of this legal research shows that in regards to the protection of consumer rights in e-commerce activities in Indonesia is still lacking. The consumer protection law in Indonesia only covers traditional commerce or offline commerce whereas online commerce is not yet mentioned. Moreover, the Indonesian consumer protection law focuses more on the consumers rather than the businesses as well, which is also important in e-commerce activities.
