The Limits and Possibilities of the ASEAN Way:

ASEAN Way telah dianggap oleh banyak pihak sebagai prinsip-prinsip yang paling bermasalah dan juga unggul, khususnya dalam pembuatan keputusan ASEAN dan proses pembuatan kebijakan. Prinsip-prinsip tersebut sangat menekankan kedaulatan negara anggota ASEAN sebagai aspek yang paling penting secara tradisional, yang mengarah munculnya persepsi bahwa ASEAN tidak mampu menggabungkan ASEAN Way dan hal-hal kemanusiaan. Dalam penelitian ini, meskipun ada dua perspektif bersaing untuk melihat jika ASEAN Way menghambat atau meningkatkan kemampuan ASEAN untuk menyelesaikan konflik, penelitian ini berpendapat bahwa sejauh mana ASEAN Way menjadi hambatan atau akselerator bergantung pada sifat dari konflik. Penelitian ini tidak menyangkal bahwa ASEAN Way mungkin satu-satunya mekanisme yang paling mungkin untuk mendekati Myanmar, tapi ASEAN Way itu sendiri tidak cukup karena ada kecenderungan bagi anggota ASEAN memutar 'mata' terhadap konflik yang tidak mencapai ke permukaan atau tidak ada diskusi yang tepat tentang hal-hal tersebut. Untuk mendukung argumen, penelitian ini akan merefleksikan argumen tersebut di atas melalui kasus yang baru saja terjadi yaitu kasus pelanggaran hak asasi manusia terhadap etnis Rohingya yang menimbulkan krisis kemanusiaan terbesar di laut setelah waktu Indo-Cina. Penelitian ini akan melakukannya dengan, pertama, menjelajahi sifat-sifat ASEAN dan, kedua, menerapkan diskusi konseptual untuk kasus Rohingya untuk menunjukkan batas-batas dan kemungkinan cara ASEAN dalam kasus ini, dan memberikan sedikit rekomendasi kebijakan terhadap ASEAN Way.

The ASEAN Way has been considered by many as the most problematic, yet superior principles in ASEAN decision- and policy-making process. The principles emphasize highly in ASEAN member states' sovereignty, traditionally, which leads to the perception of ASEAN's inability to reconcile the ASEAN Way and humanitarianism. In this research, despite the two competing perspectives of whether the ASEAN Way is hindering or enhancing the ability of ASEAN to settle conflicts, this research argues that the extent to which the ASEAN Way becomes limitation or accelerator depends on the nature of the conflict. Not to deny that the ASEAN Way may be the only possible mechanism to approach Myanmar, but the ASEAN Way itself is not enough because there is a tendency for ASEAN members turning 'a blind eye' towards a conflict that does not reach into the surface or there is no proper discussion about it. To support the argument, this research will illustrate the above-mentioned argument through the recent case of massive Rohingya human rights prosecution that results in the biggest crisis in sea after Indo-china. This research will do so by, firstly, exploring the nature of the ASEAN way and, secondly, applying the conceptual discussion to the case of Rohingya in order to show the limits and possibilities of the ASEAN way in this particular case, and provides a little of policy recommendation towards the ASEAN Way.
