Studi implementasi kebijakan pemekaran daerah di Kabupaten Aceh Barat

Sejalan dengan perkembangan dan kemajuan daerah serta adanya aspirasi dari masyarakat, Kabupaten Aceh Barat dimekarkan menjadi 3 Kabupaten. Dasar hukum pelaksanaannya adalah Undang-Undang Nomor 4 Tahun 2002 yang membagi daerah Kabupaten Aceh Barat menjadi Kabupaten Aceh Jaya, Kabupaten Nagan Raya serta Kabupaten Aceh Barat sendiri sebagai Kabupaten induk. Undang-Undang tentang Pemekaran Daerah tersebut telah lebih dari satu tahun diimplementasikan namun belum dapat dilaksanakan sebagaimana mestinya. Oleh karena itu, Penelitian ini bertujuan untuk mendeskripsikan sejauhmana pelaksanaan implementasi Kebijakan Pemekaran Daerah di Kabupaten Aceh Barat melalui Undang-Undang Nomor 4 Tahun 2002 dan untuk mengetahui faktor-faktor yang mempengaruhinya. Metode penelitian yang digunakan adalah kualitatif dan data diperoleh dari wawancara, observasi dan dokumentasi. Variabel-variabel yang dipergunakan untuk mencapai tujuan penelitian adalah Kejelasan Substansi Kebijakan Publik, SDM Aparat Implementator, Struktur Birokrasi Implementasi serta Kondisi Lingkungan dimana kebijakan itu diimplementasikan. Keempat variabel tersebut dipilih karena dianggap memiliki kesesuaian dengan fokus dan lokus penelitian. Hasil penelitian menunjukkan bahwa dari 5 kegiatan pokok yang harus dilakukan dalam rangkaian proses pemekaran Kabupaten Aceh Barat yaitu peresmian Kabupaten baru dan pelantikan Penjabat Bupati,pembentukan Organisasi Perangkat Daerah, pembentukan Dewan Perwakilan Rakyat Daerah, pemilihan Bupati dan Wakil Bupati yang definitif serta serah terima Asset Daerah dari Kabupaten induk kepada Kabupaten yang baru, hanya 3 kegiatan pokok saja yang baru dilaksanakan yaitu peresmian Kabupaten baru dan pelantikan Penjabat Bupati,pembentukan Organisasi Perangkat Daerah, pembentukan Dewan Perwakilan Rakyat Daerah. Implementasi Kebijakan Pemekaran Daerah tersebut dipengaruhi oleh faktor-faktor : ketidakjelasan Substansi UU nomor 4 Tahun 2002, rendahnya pengalaman dan penguasaan tugas aparat implementator, tidak adanya Tata Kerja Organisasi Komite Pemekaran Daerah serta Kondisi Sosial Ekonomi dan Sosial Politik yang kurang mendukung. Beberapa saran yang dapat diajukan berkaitan dengan permasalahan yang dihadapi dalam rangka implementasi Kebijakan Pemekaran Daerah ini adalah untuk Bidang Pengkajian Hukum Komite Pemekaran Daerah seyogyanya ditunjuk personil yang memiliki basis keilmuan di bidang Hukum Tata Negara dan atau yang memiliki tugas di bidang hukum dan perundang-undangan, komposisi personil Komite perlu segera di-reshuffle, Tata Kerja Organisasi perlu segera disusun, agar Pemerintah segera menggalang persatuan dan bahu-membahu dengan masyarakat untuk membantu aparat keamanan dalam rangka penyelesaian konflik keamanan.

In accordance with region progress and aspirations from community, the District of West Aceh is splited to be three districts. The process of spliting this region had done with the Regulation Number 4 of 2002, its splited the District of West Aceh to be Aceh Jaya District, Nagan Raya District and Aceh Barat District as base district. The Regulation Number 4 of 2002 a bout The Spliting Region at The West Aceh District has been implementating for one year, but its not effective yet. So, this study is aimed to discribe the process of spliting region at The Aceh Barat District with The Regulation Number 4 of 2002 along with its influencing factors. The method of study to be used here is qualitative descriptive that emphasizing on field research to describe the real conditions. Data was got from interview, observation and documentation. The Variables to be use here in order to get the aims of the study are content of the spliting region policy, human resource of the implementator, structure of bureaucracy of the spliting region comittee, and the environment conditions where the public policy was implementated. All the variables was choiced because its has compatibility with focus and location’s research. The study results indicated that in order to enforce the Regulation Number 4 of 2002, its has five activities must be done. They are : dedication of districts and installation the chief of the new districts, the establishment of the local government organizations, the establishment of legislative organizations, the election of devinitive chief districts, and the trasfer of asset from the base district to the new districts. Now, from the five activities, just three activities had done, they are dedication of districts and installation the chief of the new districts, the establishment of the local government organizations, and the establishment of legislative organizations. Furthermore, the process of policy implementating of spliting region at West Aceh District, it was influenced by content of public policy that unclear, implementators has low experience and low capability to do theirs job, the organization structure of the spliting region committee has not job description or the rules of the game, and the environment conditions (social economy and social politic) that unconducive in West Aceh. In order to solve the problems confronted against in the process of implementating public policy of spliting region at West Aceh District, recommendations proposed here are : the personnel of Division of Law’s Analysis in Spliting Region Commettee should be contented has the basic of Law knowledge and or has job on the Law division, reshuffle the implementators composition, arrange the job description of the implementation organization immediately, and the local government officers should joint the communities to help militery officer in concerning to solved security conflict.
