Efektivitas Putusan Mahkamah Konstitusi dalam Pengujian Undang-Undang Terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945

Intisari Penelitian ini membahas mengenai efektivitas Putusan Mahkamah Konstitusi dalam pengujian Undang-Undang terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Putusan Mahkamah Kontitusi merupakan putusan pengadilan khusus yang memiliki kekuatan final dan mengikat serta bersifat erga ormes. Akan tetapi dalam pelaksanaan putusan, ditemukan beberapa putusan yang tidak efektif sehingga tidak menjamin perlindungan terhadap hak konstitusional warga Negara. Penelitian ini mengkaji efektivitas Putusan Nomor 92/PUU-X/2012, Putusan Nomor 19/PUU-X/2012, Putusan Nomor 66/PUU-XI/2013, Putusan Nomor 18/PUU-I/2003, dan Putusan Nomor 9/PUU-VII/2009. Dari penelitian tersebut ditemukan penyebab putusan Mahkamah Kontitusi tidak efektif serta menemukan solusi agar putusan menjadi efektif dan dapat dilaksanakan dalam pembuatan putusan maupun pelaksanaan putusan.

Abstract this study discusses the effectiveness of the Decision of Constitutional Court on judicial review of Law with the Indonesian Constitution 1945. Decision of Constitutional Court is a special court decision that has the power of final and binding and also bind all of citizens (erga omnes). But in the implementation of the decision, there are some decisions that are ineffective, so it does not guarantee protection functions against the constitutional rights of citizens. This study examines the effectiveness of the Decision No. 92/PUU-X/2012, Decision No. 19/PUU-X/2012, Decision No. 66/PUU-XI/2013, Decision No. 18/PUU-I/2003, and Decision No. 9/PUU -VII /2009. From this research, it was found found the cause of the Constitutional Court decision ineffective and find a solution so that the decision becomes effective at the time of decision-making and implementation of decisions.
