Refleksi Kritis Terhadap Sistem Pemilihan Presiden dan Wakil Presiden secara Langsung di Indonesia Berdasarkan Sila Ke-IV Pancasila dan Pengaruhnya Terhadap Kehidupan Masyarakat Indonesia

Penelitian ini dilatarbelakangi oleh kondisi yang diakibatkan oleh sistem pemilihan presiden dan wakil presiden secara langsung. Banyak polemik yang muncul dari adanya sistem pemilihan presiden dan wakil presiden secara langsung. Mulai dari konflik di masyarakat, tingginya biaya pemilu dan perilaku pemilih yang terkadang tidak rasional. Banyak pihak mempertanyakan tentang model pemilihan presiden secara langsung tersebut karena dalam Sila ke-IV Pancasila tidak dinyatakan secara eksplisit tentang pemilihan presiden dan wakil presiden secara langsung. Oleh karena itu, penelitian ini bertujuan untuk mendapatkan pemahaman mengenai pemilihan presiden dan wakil presiden secara langsung yang ditinjau dari Sila ke-IV Pancasila. Penelitian ini merupakan penelitian kepustakaan, menggunakan metode hermeneutika dengan model penelitian mengenai masalah aktual yang diadaptasi dari Anton Bakker dan Achmad Charris Zubair untuk membahas permasalahan yang muncul akibat adanya sistem pemilihan presiden dan wakil presiden secara langsung dengan unsur-unsur metodis deskripsi, interpretasi, holistika dan kesinambungan historis. Hasil yang dicapai dari penelitian ini adalah pertama, pemilihan presiden dan wakil presiden secara langsung yang ada di Indonesia terjadi akibat adanya amandemen Pasal 6 ayat (2) UUD 1945 menjadi Pasal 6A ayat (1) UUD 1945 yang berbunyi "Presiden dan Wakil Presiden dipilih dalam satu pasangan secara langsung oleh rakyat". Kedua, Sila ke-IV Pancasila sangat mendukung kedaulatan rakyat dengan menjunjung tinggi sikap hikmat kebijaksanaan dan permusyawaratan/perwakilan. Ketiga, bahwa pemilihan presiden dan wakil presiden secara langsung tidak menyalahi pokok pikiran Sila ke-IV Pancasila. Hal ini disebabkan karena pemilihan presiden dan wakil presiden merupakan amanat rakyat sehingga kedaulatan rakyat harus dilaksanakan. Pemilihan presiden dan wakil presiden secara langsung memiliki dampak positif dan negatif bagi kehidupan masyarakat Indonesia. Dampak positifnya antara lain a) berpikir kritis; b) peduli dan c) saling menghargai. Sedangkan dampak negatifnya a) konflik antar masyarakat; b) tak acuh; c) saling curiga dan berprasangka buruk; d) pendendam; e) melanggengkan perilaku koruptif dan f) hidup boros. Terlepas dari dampak tersebut, pemilihan presiden dan wakil presiden secara langsung tetap dilaksanakan tentunya dengan evaluasi yang menyeluruh agar hasil pemilihan sungguh-sungguh kehendak rakyat.

This research is motivated by the conditions caused by the system of election president and vice president directly. Many polemics that arise from the presence of election president and vice president directly. Start of conflict in society, the high cost of elections and voting behavior are sometimes irrational. Many people questioned on direct presidential elections models such as the Sila-IV Pancasila is not stated explicitly about the election of president and vice president directly. Therefore, this study aims to gain an understanding of the election of the president and vice president directly the terms of Sila-IV Pancasila. This study is a literature, using the method of hermeneutics with the research model on actual problems adapted from Anton Bakker and Achmad Charris Zubair to discuss the problems that arise as a result of the presidential election system and vice president directly with elements methodical of the description, interpretation, holistic and historical continuity. The results obtained from this study is the first, election the president and vice president directly in Indonesia are the result of the amendment of Article 6 paragraph (2) of the 1945 Constitution as Article 6A paragraph (1) of the 1945 Constitution which reads "The President and Vice President elected as a pair directly by the people". Second, Sila-IV Pancasila strongly support the sovereignty of the people by upholding the attitude of wisdom and consultative/representative. Third, that the election president and vice president directly does not violate fundamental mind Sila-IV Pancasila. Because election the president and vice president directly is the mandate of the people so that the people's sovereignty should be implemented. Election of the president and vice president directly has a positive and negative impact to the lives of Indonesian society. The positive impact among others a) critical thinking; b) care and c) mutual respect. While the negative impact a) conflict between communities; b) indifferent; c) mutual suspicion and prejudice; d) vindictive; e) perpetuate corrupt behavior and f) living lavishly. Regardless of the impact, the election of president and vice president directly remain to be implemented of course with a thorough evaluation of the results of the election that truly will of the people.
