PERANG NGAKAL TRANSAKSI TANAH DAN GONCANGAN SOSIAL DALAM INTRODUKSI KELAPA SAWIT DI WILAYAH PEDESAAN KALIMANTAN BARAT

Konon tebas-bakar untuk membuat ladang sudah terjadi di Kalimantan sejak ratusan tahun yang lalu. Seiring waktu matapencaharian masyarakat pun berkembang, menyadap getah karet, sampai suatu kali ada perusahaan swasta perkebunan kelapa sawit mengajak masyarakat untuk “berkerja sama”. PT. DSP, perusahaan itu menawarkan pola inti-plasma. Seluruh masyarakat Ensunak menyerahkan tanahnya pada perusahaan itu. Namun plasma yang didapatkan masyarakat tidak seperti yang dijanjikan oleh PT. DSP sebelumnya. Masyarakat kecewa, merasa ditipu oleh perusahaan sementara mereka masih menanggung beban kredit atas kebun plasma itu. Lebih dari sepuluh tahun kemudian perusahaan baru bernama PT. AAC datang menwarkan pola yang berbeda, “kemitraan”. Seolah-olah tawarannya berbunyi: seorang menyerahkan tanah 10 hektar, maka ia akan mendapatkan 20% pada setiap kali panen. Namun simpangsiur berita baru-baru ini justru mengungkapkan bahwa 20% itu untuk plasma dari seluruh lahan yang diserahkan masyarakat kepada perusahaan, dan setiap hektar yang diterima warga masih dibebani kredit sebesar 35 juta rupiah. Adapun, kini masyarakat Ensunak banyak yang justru menjual tanahnya. Munculah pertanyaan, mengapa masyarakat yang pernah “kecewa” pada perusahaan kelapa sawit itu masih mau menyerahkan tanahnya pada PT. AAC?. Alih-alih memelihara tanah yang tersisa, kenapa mereka malah menjual tanahnya? Apa konsekuensinya?. Bagaimana bisa sebuah dusun bisa “diminati” dua perusahaan kelapa sawit, masih mampu menjual tanah, apa dan seberapa luas batasnya? Menjawab persoalan itu, tesis ini akan mengurai tentang sejarah pengusaan tanah, kemudian secara khusus akan melihat proses perubahan agraria, khususnya tanah-tanah yang dikonversi menjadi perkebunan kelapa sawit. Dari proses penyerahan lahan dari masyarakat ke perusahaan sampai pada transaksi jual-beli tanah yang terjadi di dusun Ensunak, Desa Meranggau, Kecamatan Meliau, Kabupaten Sanggau, Kalimantan Barat. Metode yang digunakan dalam penelitian ini adalah observasikomunikatif. Adapun wawancara sedikit digunakan untuk mengetahui data sejarah dan melengkapi kekurangan data. Analisis peta, juga studi literatur dengan mengumpulakan artikel, berita surat kabar, majalah dan buku lain digunakan untuk membuat data perbandingan dalam melengkapi studi ini. Alhasil penelitian ini sanggup menunjukkan bahwa “adat” masih mengatur hukum hingga pola kepemilikan tanah, namun klaim-klaim tanah demi kepentingan penyerahan lahan pada perusahaan hingga jual-beli terus terjadi. Pada praktiknya dengan akal-akalan, baik anggota masyarakat Ensunak ataupun oleh perusahaan dan pemilik perkebunan kelapa sawit skala besar. Privatisasi tanah dengan sertifikasi negara seolah tidak ada gunanya dan menuai sengkarut masalah baru. Berbagai pilihan dan tindakan itu punya konsekwensi, baik secara sosialbudaya, politik-ekonomi juga ekologi.

It is said that the slash-and-burn method for opening fields has been used in Kalimantan since hundreds of years ago. As time passed the livelihoods of the community have evolvedto tapping rubber, then a private oil-palm plantation company came and invited the people to “cooperate” with them. It was PT. DSP that offered them an inti-plasma scheme. The entire community of Ensunak entrusted their land to this company. However the condition of theplasma land that the community obtained was not as promised. The community was disappointed, they felt cheated by the company while they were still in debt for the plasma scheme. More than ten years later a new company named PT. AAC came, offering a different scheme: “kemitraan”. The offer vaguely states: by handing over 10 hectares of land to the company, the land owner shall receive 20% of each harvest. However it turns out that the 20% actually refered to theplasma portion of the whole estate only, while every hectare obtained by the community is credited 35 million rupiah. Therefore, many of the people of Ensunak chose to sell their land. A question reveals, why would the people of Ensunak who have been “disappointed” with an oil-palm plantation company in the past, still want to hand over their land to PT. AAC?. Why did they choose to sell their land, and not preserve what they have left? What are the consequences?. How can one village that is taken interest by two oil-palm companies, still be able to sell land, what and how far are its borders? To answer these questions, this thesis will analyze the history of land ownership, then specifically look at the process of agrarian change, especially for land plots that have been converted into oil-palm plantations. The scope of this study will be from land consignments between the community and the company until land transactions that happen in the hamlet of Ensunak,in Meranggau village, Meliau sub-district, Sanggau district, West Kalimantan. The communication observation method is used in this study. Some interviews were done to find out the historical data and to complement the lack of data. The literature study by collecting articles, news reports, magazines and other books is also needed for the comparative data to complete this study. As a result this study shows that the “local customs” still control the community law system to the patterns of land ownership. However claims over land in accordance to the land handovers to companies and land transactions are still evident. In the practice itself, the act of trickery is done quite frequently, by the people of Ensunak and also the companies and large-scale oil-palm plantation owners. The privatisation of land using national certificates seems to be useless and actually creates new problems. These various options and actions have consequences, either in the socio-cultural, political-economic, or ecological aspect.
